Martin, Planning Commission Chairman, dated October 21, 1975 , transmitting for adoption proposed. Rule 9, Rules and Regulations Relating to Environmental Shoreline Protection, to establish special interim manage- , ment procedure of developments within an area along the shoreline while a coastal zone management program is being developed; informs that pursuant to Act 176, these rules and regulations must be in effect no later than December 1, 1975 . Recommend adoption of Rule 9, Rules and Regulations Relating to Environmental Shoreline Protection. No. 625. 3 : NOISE CONTROL ORDINANCE (C-625 , 625 .1, 625. 2/PRDLC-56) (Bill 186) From Deputy Corporation Counsel Lionel D. Meyer dated October21, 1975,submitting as requested an ordinance to control vehicular noises as well as other types of disturbances. Recommend passage of Bill 186 on first reading and refer to affected County agencies for comments . (Mrs . Yadao voted with reservation). V., _9..: 15... • Aft PRDLC-62 - 2 - November 11, 1975 ,L,6',_ No. 1499.2: CORPS OF ENGINEERS RULES AND REGULATIONS "PERMITS FOR ACTIVITIES IN NAVIGABLE WATERS OR OCEAN WATERS" From Planning Director Raymond Suefuji dated October 30, 1975, commenting on the presentation made by the Corps of Engineers at the public meeting on October 21 regarding their subject rules and regulations; informs that they have asked the Corps for specific boundaries under their jurisdiction for this island but have not received a response as yet. Receive and file and request the Planning Director to follow up. No. 1529.1: STATE NATURAL ENERGY LABORATORY (NELH) Copy of letter to Mr. Christopher Cobb, Chairman,Board of Land and Natural Resources, from William R. Coops, Administrator, The Research Corporation of the University of Hawaii, dated October 22, 1975, requesting a negative Environmental Impact be determined for the research project on BioFouling and Corrosion of Heat Exchanger Tubing to be conducted at NELH site at Ke-Ahole Point and land use permit be authorized for the project and temporary facilities . MOTION 'M-65 : RE-EVALUATION OF KAIMU-KALAPANA AREA The Planning, Research, Development & Legislative Committee look at the possibility of re-evaluating the entire Kaimu- Kalapana area as a destination area. Receive and file. (See Bill 188) ORDINANCES Bill 183 : REZONING REQUEST - MAUDE CHANG -(C-1610) PIIHONUA, SOUTH HILO (TMK: 2-3-13 :20) Amends Section 7.29, the City of Hilo Zone Map of Chapter 8 (Zoning Code) , Article 2, Hawaii County Code, as amended, by changingthe district classification from Office Commercial (CO-20) to General Commercial (CG-7.5 ) at Piihonua, South Hilo, Hawaii , covered by Tax Map Key 2-3-13 :20. Approve and recommend adoption on second and final reading. Bill 188 : KALAPANA-KAIMU AREA Relating to deferral of amendments to Chapter 8 (Zoning Code) of the Hawaii County Code, as amended, relating to the Kalapana-Kaimu area. RECOMMENDATION No. 1: ENVIRONMENTAL SHORELINE PROTECTION Refer communications from Mr. Rothstein (C-227.4, 227. 5 and 227.8) ; Mr. Levin (letter attached) and the Shoreline Protection Alliance (C-227. 6) to the Planning Department, Planning Commission and Corporation Counsel for possible amendment to the rules and regulations relating to the Environmental Shoreline Protection. • 411 November 10, 1975 TO: RAYMOND SUEFUJI or SIDNEY FUKE FROM: ANDREW C. LEVIN I would like to suggest the following changes to the shoreline rules and regulations. 1. To Conform to Act 176, a. Add to 9. 1(D) (2) and (15) the word "organization" after "individual. " b. Delete from 9. 3(B) the word "possible. " c. Add to 9.4(A) the words "in order to ensure" after "Authority. " d. Delete from 9. 4(B) (1) the words "and welfare. " e. In 9.4(C)(5) change "structure" to structures. " f. Add to the Rules the "Special Management Area Objectives" contained in the Act (205A-4) . This would perhaps best be included in 9. 1(B) Purpose. 2. For Clarity, a. Add to 9, 5 the words "purposes and guidelines" after "policies. " 3. 9. 7(C) (1)(b) Require, in addition to concurrence of the Chief Engineer, concurrence of the Authority. 4. 9. 8 Reduce filing fee unless application is made in bad faith. 5. 9. 12(3) Add, after "crops, " "unless such planting, harvesting or removal is undertaken for the purpose of circumventing the objectives of Act 176 and these Rules. " 6. 9. 15 and 9. 16 Do not require filing fee in those cases where request is made by a govenment official, department or agency, or where three or more members of the Authority agree that the request has substantial merit_. .
