The following are the recommendations of the Planning, Research, Develop-
ment and Legislative Committee which were considered at its meeting of
January 13, 1976 :

No. 313. 3 : KONA VENTURES APARTMENT COMPLEX (ORDINANCE 594)
HIENALOLI 5th, NORTH KONA
Copy of letter to Earl Younker, President, Kona Ventures ,
from Planning Director Raymond Suefuji dated December 22,
1975, approving a one year extension of the commencement
of construction time condition, as stipulated in
Ordinance 594, until December 22, 1976, on the basis
of financing and reasons as stated in his December 8
communication.

Ace.. No. 541. 18 : PARK DEDICATION ORDINANCE
From Ernest A. Smith, Vice President and Manager, Brewer
• Support Housing, Inc. , dated December 4, 1975 asking that
passage of the Park Ordinance be deferred indefinitely,
pending a review and reconsideration of Act 140 by the
State Legislature.

No. 625 . 6: NOISE CONTROL ORDINANCE (BILL NO. 186)
From Prosecuting Attorney Paul M. De Silva dated December 5 ,
1975, submitting comments on the noise control ordinance.
It is his opinion that Section 711-1101, Disorderly Conduct,
as amended, of the Hawaii Revised Statutes does provide

police with a means of dealing with the usual types of
complaints which have been received from the citizenry
and suggests that before any action is taken on Bill 186
that it be given careful study to see whether or not the
elaborate and costly enforcement effort which would
result would be a wise investment; also expresses concern
about the effect of the bill on certain customary com-
munity noise-making and on certain types of commercial
and industrial noise.
Recommend that the proposed Bill
for an Ordinance No. 186 relating
to noise control and all related
correspondence be filed.
'7o. 1005 .6 : MAMALA HEIAU
From Planning Director Raymond Suefuji dated December 15 ,
1975 , transmitting a copy of letter received from Jane L.
Silverman, State Historic Preservation Officer, relating
to the Mamala Heiau. Under the present timetable, it does
not seem likely that acquisition can occur until fiscal
year 1977.

No. 1499.4; CORPS OF ENGINEERS RULES AND REGULATIONS
"PERMITS FOR ACTIVITIES IN NAVIGABLE WATERS OR OCEAN WATERS"
From Planning Director Raymond Suefuji dated December 24,
1975 , transmitting a copy of letter from the Corps of
Engineers ; appears that the Corps will generally issue
permits for work endorsed byagencies. The only
local encies

exception that might override certification or authoriza-
tion of a proposed work would be where national concern so
dictates ; however, they feel these cases would be the
exception rather than the rule.

No. 1529 .4: NATURAL ENERGY LABORATORY HAWAII (NELH)
Copy of letter to Christopher Cobb, Board of Land and
Natural Resources , from William R. Coops, Project Adminis-
trator, The Research Corporation of the University of
Hawaii, dated December 22, 1975, requesting that the
Conservation District Use Application for the laboratory
site at Ke-ahole Point be withdrawn at this time; the
application will be resubmitted as soon as the Environmental
Impact Statement is completed and the "Shoreline Protection
Area" permit is obtained.

No. 1589.3 : HENRY OPUKAHAIA SCHOOL' S USE OF OLD HILO MEMORIAL HOSPITAL
AND GROUNDS
From Mayor Herbert T. Matayoshi dated January 6, 1976,
responding to request for the administration' s position
regarding the Henry Opukahaia School' s use of the old
Hilo Memorial Hospital and grounds . Informs that County
operations now use a portion of the building and the
University of Hawaii has the north wing and central
section; suggests that the School negotiate with the
University for space in their area not now in use.

LUCY HENRIQUES MEDICAL CENTER
From Mark Sperry, Health Care Coordinator, Lucy Henriques
Medical Center, dated October 31, 1975, requesting a
variance to allow two entry signs of 20 square feet each
to their proposed medical center in Kamuela.

recommending approval of the variance, subject to the
recommendations stated.

and approve sign variance request, subject
to recommendations stated.
No. 1659 : PAPAYA PETITION
From John Farias , Jr. , Chairman, Board of Agriculture,
dated December 2, 1975 , advising on status of the papaya
petition, jointly submitted by USERDA-DBER (U. S. Energy
Research and Development Administration - Division of
Biomedical and Environmental Research) and USDA-APHIS
(U. S . Department of Agriculture - Animal and Plant Health
Inspection Service) requesting that a regulation be adopted
which would allow radiation treatment of papaya as an
alternative to the use of chemical fumigants for treatment
and shipment of papaya from quarantined areas to the
mainland United States .

• Housing Agency on November 19, 1975 ; believes the report
essentially responds to Rec. 1/PRDLC-44.
