The following are the recommendations of the Planning, Research, Develop-
ment and Legislative Committee which were considered at its meeting of
July 13 , 1976.
COMMUNICATIONS
No. 181.6 : NOISE LAW
From Owen Miyamoto, Chief, Airports Division, State
Department of Transportation, dated June 24, 1976,
informing that State noise regulations were recently
promulgated by the Department of Health and enforced
by that department and County police Departments ; it
is his understanding that said regulations exempt air-
craft noise from their coverage since the regulation
of aircraft in flight has long been pre-empted by the
Federal government and is exercised by FAA. Encloses
copy of portion of Part 91 Federal Air Regulations which
relates to minimum flight altitudes and flight clearance
over populated areas .
181. 7: From Glen W. Welsh, Chief, Flight Standards Division,
Department of Transportation, Federal Aviation Admi-
nistration dated June 30, 1976, informing that their
Flight Standards District Office (FSDO) located at
Honolulu International Airport is charged with enforcing
incidents indicating unsafe operation or possible vio-
lation of Federal Aviation Regulations in the State.
However, because the complaint is very general no
specific investigation can be conducted without more
detailed information; informs they will advise the
FSDO of the general complaints for future observation
of aircraft operations.

From Councilman Levin dated June 17, 1976, urging the
Committee to instruct the Administration:to immediately
renew efforts to reestablish the ancient Hawaiian trails
on the Big Island, and to report back to Council within
a reasonable time on the progress that has been made.

From Councilman Dante K. Carpenter. dated June 25, 1976,
informing that intent of Bill' 232' is to formally rein'=
' state Item 3 of the Hilo Downtown Development Plan to .
"retain the Police Department Building, the Armory,
and several of the older wooden structures which had
previously been slated for, removal" ; and with the
adoption of Bill 232, the Council' s action will be fol-
lowed as far as retention of the former police station
building for public use. Submits for review an extract
of;t the Hilo Downtown Development Plan.' -
