The following are the recommendations of the Planning, Research, Develop-
ment and Legislative Committee which were considered at its meeting of
October 26, 1976 :
COMMUNICATIONS
No. 81: ACQUISITION OF KE ALA KO WA'A HEIAU
From Councilman Kawahara suggesting . County look into
acquisition of heiau. Dated January 11, 1973.
X81. 1: From Planning Director dated March 13, 1973 submitting
their findings and recommending site be accepted if
donation offer is a reasonable one.
81. 2 : From Donn W. Carlsmith, Managing Director of Dillingham
Investment Corporation, dated May 9, 1973, informing
still interestedin effecting an exchange with the State
for heiau property, however, amends their original offer
by stating they would be agreeable to an exchange of
lands in either North or South Kona districts .
81. 3 : From Chairman & Member of Board of Land & Natural Resources
dated July 13, 1973, agreeing that heiau should be preserved,
however, regrets that State is unable to participate in
acquisition and preservation of site due to tremendous
strain in the State's fiscal picture; urges County and
private interests acquire heiau, restore it and interpret
it for the people of Hawaii.
x_ 81.4: From Chris Cobb, Chairman & Member of Board of Land &
Natural Resources , dated March 13, 1975 , informing State' s
financial condition has not changed and it is impossible
for State to undertake responsibility of restoring and
maintaining heiau; suggests County and Dillingham Invest-
ment Corporation work together in restoring heiau for
people of Hawaii.

�No. 124.1: RESTRICTING OF ANIMALS & LIVESTOCK
(Ord. 607) From Gordon Lent, General Manager of Parker Ranch dated .
September 17, 1973, stating Ordinance should provide
exemptions of. areas designated as Open Range and/or
provision put in that would allow the appropriate
official to designate certain road as Open Range and
not be affected by the Ordinance.
124. 2: From Prosecuting Attorney ,c1e Silva dated October 18,
1973, informing' that in his opinion Sec. 2 of Ord. 607
is unworkable; recommends new ordinance be drafted to
eliminate requirement of 24-hour notice as it pertains
to certain type of animals in densely populated areas
does 'not''believe penalty should apply to trespassing
dogs 'or cats ; suggests provision for consideration.
124. 3: From Councilman Carpenter submitting , letter and petition
from concerned members of Waiakea-Uka community pointing
out several deficiencies in Ordinance 607 and .recommeriding
immediate action to strengthen the Ordinance to cover areas .
of indicated concern. Dated November 19, 1974.

September 16, 1975, submitting comments and recommendations
on Ordinance 607 for purposes of discussion.

4. 467: COLLEGE OF TROPICAL AGRICULTURE
From Mayor Shunichi -Kimura dated- September, l3, 1973,
submitting report on College; contains findings of a
study on feasibility of establishing a school for
agriculture in County by relocating all or portion of
College to Big Island.

Hawaii Unit, dated February 5, 1976 supporting bill.

consideration of Bill 203 and suggests deletion of the
words "ten (10) or more" in sentences a and d of Section 17.

submitting for review and consideration a status report
on the "No Smoking" bills introduced by each county and
copies of the bills ; also suggests changes to Bill 203.

Inc. ,.. Big Island Unit, dated March 25, 1976, urgently
requestingand endorsing favorable action on Bill 203 and
suggests deleting "the number 10 or more" from the bill.
1652.12 : . From Council Chairman.;Yamada dated April 1, 1976 transmitting
for consideration an amended bill based on the concerns that
were expressed at the -public hearing.
1652.13 : . , From Councilman Levin dated April 5 , 1976 proposing amend-
ments to Bill 203, the no-smoking -bill. • .
1652.14: From . Councilwoman Lai dated April 13, 1976 informing of
Section 17-214 on "Smoking" from the 1967, Edition of the
Life Safety Code which has the "force and effect of law" ;
asks whether this section can be seriously considered if
Bill 203 is not . approved.
1652.15 : From Councilwoman Merle K. Lai dated July, 1, 1976
submitting for consideration results of a survey of
the general public's opinions regarding Bill 203.
Reiterates. that if Bill 203 is not approved, Section 17-214
of the Life 'Safety Code should be strongly considered in
its place.

A u, C- 1652.16 : From Deputy Corporation Counsel Lionel D. Meyer dated
July 9, 1976, answering in the affirmative in response
to Councilwoman Lai ' s request for an opinion as to
whether Section 17-214 of the Life Safety Code has the
force and effect of law. However, it is the belief
of the Fire Chief and Fire Inspector that there will
be a manpower problem in the event the Fire Department
is mandated to enforce the "No Smoking" regulation in
all places of assembly and, therefore, suggests the
regulations be voluntarily adhered to where plainly
visible "No Smoking" signs are posted.

of Hawaii to appropriately place

facilities .
No. 1869 : CONSTITUTIONAL CONVENTION
From Samuel B. K. Chang, Director, Legislative
Reference Bureau, dated May 10, 1976, informing that
during the 1976 Legislative session the House of
Representatives introduced and adopted House Resolution
No. 336, "Requesting a report on constitutional problems
and issues to provide the public sufficient information
to make an informed decision on the need for a consti-
tutional convention" , and asks input with regard to
constitutional problems and issues for possible con-
sideration in the next constitutional convention.

�No. 2063 : COMPLAINT AGAINST ELECTION PROCEDURES
From Bridget and William Pittman filing complaint against
the County for not being allowed to run for a County
Council at large seat.

No. 2073 : PUBLIC HIKING TRAILS PROGRESS REPORT
From Mayor Herbert T. Matayoshi dated October 14, 1976
informing that the State is now inventorying the trails
on the Island of Hawaii and this survey/inventory is

expected to be completed by December of this year.
- , Once it is completed, recommendations for acquisition
of trails will be made to DLNR from which matching
grants can be made available.
