The following are the recommendations of the Legislative Committee
which were considered at its meeting of May 9, 1973 :
COMMUNICATIONS
Comm. 257: COMPLAINT - HANDLING OF PUBLIC COMMUNICATIONS
From Hugh Clark, Big Island Bureau Chief, Honolulu.
Advertiser, and Eugene Tao, County Government
Reporter, Hawaii Tribune-Herald, dated April 18,
1973, renewing their complaint over the handling
of public communications received by the County
Council and County Clerk's Office and requests a
prompt settlement of this problem.

expressing appreciation for the support and
cooperation of Hawaii County's Legislative
Committee during the last legislative session.

RECOMMENDATION
No. 1 : PUBLIC COMMUNICATIONS
Recommend that the Council adopt the following policy
regarding public communications :
(A) All communications addressed to the
(1) Chairman of the Council and Members of the
County Council;
1-+ (2) The County Council;
<' (3) Chairman of the Council; and
(4) Chairman of a committee
shall be opened immediately by the Clerk's Office
upon receipt of the communication and processed
in the same manner by giving it a communication
number with the proper referral and shall become
public record. Where there is a question on
whether the communication is a personal one or
County business, the County Clerk shall make the
determination.
(B) Exceptions :
( 1) Where public inspection of such communication
is in violation of any county, state or
federal law.
( 2) `,There it invades the privacy, character or
reputation of an individual.

AMENDMENT
A, Recommendation No. 1: PUBLIC COMMUNICATIONS
<601.1/7 Recommend that the Council adopt the
following policy regarding public
communications:
(A) All communications addressed to the
(1) Chairman of the Council and
Members of the County Council; and
(2) The County Council
shall be opened immediately by the
Clerk' s Office upon receipt of the
communication and expeditiously
processed by giving it a communication
number with the proper referral by the
Council Chairman and shall become public
record. Where there is a question on
whether the communication is a personal
one or County business, the Chairman
of the Council shall make the determina-
tion.
