The following are the recommendations of the Legislative
Committee which were considered at its meeting of June 5, 1973 :

COMMUNICATIONS
Comm. 181: NOISE AND AIR POLLUTION
From Councilman Kawahara dated February 23, 1973,
suggesting that the Council initiate steps to have
ordinances to control the increasing noise and air
pollution in this County.
181. 1: From Councilman Kawahara dated March 2, 1973 , trans-
mitting a petition from the Kona Senior Citizens
requesting enforcement of the State anti-noise law.
,Sc, Y181. 2 : From Margaret Wakefield, President, Kona Senior
Citizens , dated May 5, 1973, informing that the
State Director of Health has written them stating
that his department will be happy to set up an
advisory committee and adopt rules and regulations
to control vehicular noise in the county, if the
County of Hawaii requests it. Asks the County
Council and the Mayor to make such a request to the
State.
`181, 3 : From Mayor Shunichi Kimura dated May 11; 1973,
reporting on the referral of communications
(C-181 & 181. 1) regarding noise and. air: pollution
in Hawaii County.
Informs that air pollution regulations of the
State Department of Health will be applicable to
the County of Hawaii in June of this year. .
Reports that the State Department of Health has
offered to develop, in coordination with a County
advisory committee, standards , rules and regulations

for implementing noise controls as authorized by
the State legislature and they will be able to
furnish the County with a number of decibel meters
essential to enforcement. However, enforcement of
the rules and regulations when they are formally
adopted will remain a problem until adequate training,
manpower and equipment is provided.
181.4: Copy of a letter to Mayor Shunichi Kimura from
Dr. Walter B. Quisenberry, Director of Health, dated
May 16, 1973, informing that he has requested
Mr. Sadamoto Iwashita, Chief of the Occupational
and Radiological Health Branch, who is administering
the noise control program for the Department, to
contact the Mayor's office and make arrangements to
meet with appropriate officials of the County to go
over the necessary steps toward the development and
eventual promulgation of noise control regulations
for the County of Hawaii.

'Comm. 290.1: LEGISLATIVE COMMITTEE CHAIRMAN
From David C. McClung, President of the State Senate,
dated May 10, 1973, informing that Councilman Frank
De Luz III, Legislative Committee Chairman, was
especially effective during the regular session of
the Seventh Legislature and looks forward to working
closely with him during the interim and the session
of 1974.
290. 2 : From Tadao Beppu, Speaker of the State House of
Representatives , dated May 18, 1973, commending the
Hawaii County Council for making an excellent choice
in selecting Councilman Frank De Luz, III , to serve
as its Legislative Chairman and to represent the
Council at the Legislature during the past session.

From Mrs . Virginia Torres dated May 8, 1973 , requesting
that an investigation on the practice of midwifery be
immediately initiated.

From Legislative Committee Chairman dated May 11,
1973, submitting a report on the 1973 legislative
session.

Comm. 315: PROPOSED REAPPORTIONMENT PLAN
From Yukio Naito, Chairman, Legislative Reapportion-
ment Commission, dated May 23, 1973, submitting for
information and file material related to the "proposed
reapportionment plan" recently made public by their
Commission.

RESOLUTION
lip. 72: KOHALA CORPORATION - AIR EMISSION STANDARDS
Resolution requesting the State Department of Health,
Air Sanitation Branch of the Environmental Health Division,
to approve the variance requested by Kohala Corporation
to allow said Corporation to continue its operations
without modifications to its equipment for compliance to
the air emissions standards.
