Hawai i TIME: 1:05 p.m. Council Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 10, reports as follows: Bill No. 10, transmitted by Mayor Harry Kim, via Communication No. 81 dated January 18, 2017, amends Ordinance No. 12-111 which amended Ordinance No. 99-116 which amended Ordinance No. 96-159 which amended section 25-8-33 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii County Code 1983 (2016 edition, as amended) (formerly referred to as Section 25-114, City of Hilo Zone Map, Article 3, Chapter 25, Zoning Code), by changing the District Classification from Single Family Residential — 10,000 square feet (RS -10) to Neighborhood Commercial — 7,500 square feet (CN -7.5) at Waiakea, South Hilo, Hawaii. covered by tax map keys: 2-2-044:003, 031 032, 035, and 037. The Windward Planning Commission recommended approval of this bill at its public hearing on January 5, 2017. for an amendment to Change of Zone Ordinance No. 12-111, which would: 1) Grant a time extension to secure final subdivision approval; 2) Modify the timing of installing drainage improvements; and 3) Reduce the fair share contribution provision for this assisted living facility. This measure is initiated by the applicant, Rhodes Moore, LLC—formerly Graphic Images Hawaii, Inc.—for property located on the southeast side of the intersection of Kanoelehua Avenue and Fast Kahaopea Street, Waiakea Homestead I louse Lots, South Hilo, Hawaii, and the subject area is 322,414 square feet. Phomas Yeh, Esq., attorney for the applicant and Mr. John Dewalt, principal, developer and representative of Rhodes Moore LLC, came forward to provide information and answer questions. Mr. Yeh stated that they had discussions regarding the flooding challenges on this property with the adjoining land owners Russell Doi and Stephanie Salazar. Mr. Yeh explained that the applicants are not allowed to change the flow of water in terms of velocity, location, width or depth from where it exits the property. He also said that the Federal Emergency Management Agency (FEMA), County Code nor common law allows the flow of water to be changed. Ile said that they are making adjustments, therefore they are asking for a five year time extension from August of 2017 to complete these improvements, prior to a certificate of occupancy being issued. He further added that they will be providing a possible emergency access road for the adjoining land owner in the event that the main common driveway has water. PC Report No. 5 PC-5 Page 2 February 21, 2017 Mr. Dewalt provided further background regarding the flood zone issues, then said that the process is going through FEMA and County engineering. He said that once there is a conditional approval, they will be able to build the improvements, then request the final approval required prior to occupancy. Mr. Yeh stated that improvements to the intersection will be provided based on the traffic impact analysis. He said they plan to provide left turn, turning pockets onto Kanoelehua Street, Awapuhi Street and into the common driveway. Mr. Yeh stated that now that they will be providing a highly needed assisted living facility that will be similar to the Pohai Nani facility on Oahu, they are seeking adjustments to the ordinance regarding fair share contributions. Mr. Yeh stated that the residents are not going to be creating traffic impacts, nor will they create park impacts. Mr. Yeh commented that this project will have memory care gardens, recreational facilities, walking paths, and will incorporate other"Blue Zones" concepts as discussed with Carol Ignacio, Blue Zones Community Program Manager for the Hawai`i Island. Several Council Members inquired regarding the concerns of the adjoining land owners, drainage improvements, engineering work, and the required Conditional Letter of Map Revision (CLOMR) and Letter of Map Revision(LOMR), to which Messrs. Yeh and Dewalt descriptively responded. Deputy Planning Director Daryn Arai came forward and explained that this project is at the zoning level and that this proposal is at its conceptual stage. Should this amendment be approved, the developer will proceed with the civil engineering work which will include the necessary design and calculations to accommodate any drainage that is generated and adequately disposed of onsite. Regarding the floodway, the intent is not to add to the volume or the direction of the flow,but to dispose of any additional drainage generated onsite and not contribute to the overall volume of the floodway.
