The following is the recommendation of the Joint Committee
comprised of the Social & Cultural Development and Legislative
Committees which was considered at its meeting of February 16, 1973 :
COMMUNICATIONS
'No. 43 : FIREWORKS ORDINANCE
From Takashi Matsui, Vice Principal, Waiakea
Intermediate School, dated December 19, 1972,
proposing consideration of the following measures
to prevent the abuse of fireworks:
1. Restrict the sale of fireworks to adults only;
2. Restrict the sale of fireworks to a relatively
short period of time, e .g. , December 26
January 1.
The intent would be to limit the source of supply
and to make parents more responsive to supervising
their children playing with fireworks. This would
prevent disruption, damage, wasted manpower and
bodily injury in schools:
43 .1: From A. J. Hall, dated December 26, 1972, informing
that his two children were injured as a result of
other children in the neighborhood playing with
fireworks, and requests the Council to seriously
consider the rewriting of the fireworks ordinance
so that children, innocent or reckless, will not
be harmed anymore.
43 .2 : From Mrs. Frances C . Sherrard, Chairman, Hawaii
County Committee on Children and Youth, dated
January 26, 1973, submitting for consideration the
following suggestions to strengthen the fireworks
ordinance:
1. That the sale of fireworks be restricted to a
set period of time during the year.

No. 43 .2 2. That the sale of certain types of pyrotechnic
(cont . ) devices be limited to those who have reached
the age of majority. These devices would be
those that are classified as "special fire-
crackers" by Ordinance 2$:
'43 .3 : From Harry C . Chuck, District Superintendent, State
Department of Education, dated January 24, 1973,
presenting their problem of the unlawful setting
off of fireworks in the schools and their concern
about the real danger of injury to innocent students
and damage to public property. Because of the
difficulty involved in apprehension and control,
appeals to the Council to make the procurement of
fireworks more restrictive. Suggests the purchasing
period and playing period be severely limited :
143 .4: From Robert F. Bean, Principal, Hilo Intermediate
School, dated February 1, 1973, expressing his
dealing that the ordinanceg with the sale
and setting off of fireworks needs to become much
more restrictive and suggests that no fireworks
be placed on sale until after Christmas Day.
Informs that each year the last couple of weeks of
school prior to Christmas vacation, the school is
disrupted by firecracker and smoke bomb violations:
"43 .5 : From Edward W. Forsythe, Principal, Honokaa High
and Elementary School, dated February 2, 1973,
seeking the assistance of the Council to review
the present fireworks ordinance. Suggests the
selling of fireworks be curbed until school is on
vacation, restrain retail vendors from selling
fireworks to minors and others that would curb
future Section 10 violations:
43 .6 : From Richard H. Matsunaga, Principal, Hilo High
School, dated February 12, 1973, explaining the
problem of students who violate the fireworks
ordinance and informs of the approaches used in
solving this problem but there are those who
continue to violate the law. Offers no quick
solution to the problem but agrees with some
principals that one partial deterrant is to sell
firecrackers after Christmas vacation begins.
Another deterrant is to prohibit anyone under 1$
to burst firecrackers and to place a penalty on
adults who permit someone under 1$ to burst fire-
crackers but this approach should not in any way
prevent the use of firecrackers for religious or
ceremonial reasons:

"No. 43 .7 : From Charles S . Kamimura, Chairman, Unit #6,
Hawaii Division, HGEA, dated February 13, 1973 ,
informing that their organization went on record
to support a proposal which would allow the sale
of fireworks to begin no sooner than the first
day of the schools' annual Christmas recess and
recommends legislative action to include this
proposal:
kc_ C - 43 .$: From Norman Rozeff, Naalehu, dated February 15,
1973, informing that he does not feel that the
present fireworks ordinance is satisfactory and
supports a more stringent ordinance, one which I
could be realistically enforced . Feels that the
Council should eliminate all personal use of fire-
works but allow public displays for holidays,
special commercial and cultural events regulated by
permits issued to licensed professionals:
Request the Corporation Counsel to
revise Ordinance 2$ to include
restricting the sale of fireworks
to a set period of time during the
year and to also take into account
other related problems as enumerated
in the communications filed with the
County Clerk and further revise the
ordinance as he deems necessary.
