The following are the recommendations of the Committee on Public Service
which were considered at its meeting of May 4, 1977 :
COMMUNICATIONS
No. 176. 3 : AMENDMENT TO TRAFFIC CODE
From Robert J. Santos, Chairman, Highway Safety Council,
dated April 18, 1977, submitting for consideration, their
recommendations regarding the State Highways Division' s
request to increase speed limits at Wainaku, Hakalau and
Papaaloa.
/(:< !` - 176.4: From F. C. Schattauer, Manager, Laupahoehoe Sugar Company
dated April 15 , 1977, strongly opposing raising of the
speed limit on Hawaii Belt Road at Papaaloa from 45 mph to
55 mph and lists reasons for their concern.
: « 0 . 176.5 : From Calvin Sueda, President, Laupahoehoe School Parent-
Teacher-Student Association, dated April 25 , 1977
informing that members of the Laupahoehoe School PTSA
oppose the proposal to raise the existing 45 mph zone at
Papaaloa-Kihalani to 55 mph because of the heavy cross
traffic in the area.
176.6: From Frederick Toledo, President, North Hilo Community
Council dated April 25 , 1977 informing that they are
opposed to raising the existing 45 mph zone at Papaaloa-
Kihalani to 55 mph and states reasons for their opposition.

'No. 239 .1 : HAPUNA BEACH STATE PARK
From Councilman Joseph P . Garcia, Jr. , dated April 25 , 1977
enclosing copy of letter he received from J. M. Souza, Jr. ,
Administrator of the Division of State Parks, concerning
plans for the installation of a warning system for the
Hapuna Beach State Park.

'No. 270 : NO SMOKING ORDINANCE (Bill 298)
From Council Chairman Harvey S. Tajiri dated April 15 , 1977
stating his reasons for supporting the no-smoking ordinance
and strongly urges in the interest of the health, comfort
and atmospheric environment of every nonsmoker, that this
ordinance receive immediate and favorable consideration.
270.1 : Presentation at April 20 , 1977 Public Services Committee
meeting by Minoru Shintani , President, American Cancer Society,
Hawaii Unit, stating that they strongly reaffirm support of
Bill 298 and urgently request favorable action of this bill
for the protection of the "health, comfort and safety of its
citizens attending public meetings and activities, transacting
business and/or visiting within premise under the jurisdiction
and control of the County of Hawaii . "
270. 2 : Presentation at April 20 , 1977 Public Services Committee
meeting by Jeani Withington, President, Hawaii Nurses Assn. ,
Department of Health, urging passage of Bill 298 which
would prohibit smoking in certain public areas.
270. 3 : Position statement from R. Lundborg, M. D. , President,
Hawaii County Medical Society, dated April 20 , 1977, strongly
endorsing Bill 298.
°270.4: Presentation at April 20, 1977, Public Services Committee
meeting by Father George De Costa, Chairman, Hawaii Advisory
Council , American Lung Association of Hawaii, expressing
deep concern with the health of the community and urges
passage of Bill 298.
270.5 : From J. Walsh Hanley, dated April 25 , 1977, recommending
that the no-smoking bill be amended to cover every nasal
prejudice. States this could be done by providing that
anyone who objects to any odor emanating from any other
persons in covered rooms and areas could request that the
source of such odor be required to vacate; a law that does
not accommodate all persons equal protection would be
unconstitutional and subject to court challenge. There
are many fragrances and odors which do not appeal to
all people which should be treated equally and in one law
if action is to be taken at all.

r.`_:. No. 272 : AMENDMENT TO TRAFFIC CODE
From Chief Engineer Edward Harada dated April 25 , 1977,
recommending amendment to the traffic code by adding 35 mph
speed limit for Ka' Imi Nani Street to be in conformance
with other streets which are also functionally classified
as collector streets.
Accept recommendation and
refer to Corporation Counsel
to prepare proper amendment.
No. 273 : COMMUNITY DEVELOPMENT BLOCK GRANT - CHILD DEVELOPMENT PROGRAM
IN PUUEO DISTRICT, HILO
From Priscilla M. Garson, Executive Director, Hawaii Island
Young Women' s Christian Association, dated April 12, 1977,
informing that they have applied for Community Development
Block Grant monies for a Child Development Program in the
Puueo District in Hilo and asks favorable consideration of
their proposal.

application to HUD. )
'No. 286: DOG CONTROL LAWS
From Deputy Corporation Counsel Earl T. Nakasato, dated
April 14, 1977 transmitting copy of letter from Ms. Maile Hart,
Manager, Hawaii Island Humane Society, and informs that she
and Mrs. Alice Greenwell of the West Hawaii Humane Society
are against the proposed dog control ordinance (Bill 289) .
They feel there are already enough laws on the books to
control animals, but these laws are not being enforced.

.u. 0 No. 293 : ORDINANCE AMENDING CHAPTER 8, ZONING CODE
(Bill 306) From Deputy Corporation Counsel Earl Nakasato submitting an
ordinance (Bill 306) to amend the zoning Code by adding a new
section, exempting that certain area in the City of Hilo,
bounded by Kinoole Street, Ponahawai Street, and imaginary
straight line extension of Ponahawai Street into Hilo Bay
and Wailuku area, from the provisions of Section 6, relating
to supplementary off-street parking and loading regulations.
Approve and recommend passage of
Bill 306 on first reading.

ORDINANCE
Bill 305 : TRAFFIC CODE AMENDMENT (C-196/PSC-7)
Amends Chapter 6 (Traffic Code) , Article 6, Section 1,
Hawaii County Code, by adding a U-turn only for mauka bound
traffic on Palani Road at the intersection of Palani Road
and Queen Kaahumanu Highway in North Kona.
