RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL
YEAR AND OF A MULTI-FISCAL YEAR AGREEMENT FOR FURNISHING
ORGANIC WASTE DIVERSION OPERATIONS IN WEST HAWAII AND EAST
HAWAI'I FOR THE DEPARTMENT OF ENVIRONMENTAL MANAGEMENT
WHEREAS, the County 2009 Integrated Resources and Solid Waste Management Plan
identified that 54% or 114,000 tons of the waste disposed at County landfills were organic
materials that could be recycled, thereby preserving valuable landfill space; and
WHEREAS, the County established in 2013 organics diversion operation sites referred
to as the West Hawaii Organics Facility adjacent to the West Hawai'i Sanitary Landfill and the
East Hawai`i Organics Facility adjacent to the Hilo Sanitary Landfill where greenwaste and
untreated wood pallets are processed into mulch; and
WHEREAS, the County has an existing organics diversion contract that will expire on
December 31, 2015; and
WHEREAS, the County is developing a new procurement to replace the current contract
for the operation of the West Hawai'i Organics Facility and the East Hawai`i Organics Facility;
and
WHEREAS, the new contract(s) will be designed for the purpose of diverting organic
waste generated from county recycling and transfer stations, landfills and other private entities
and sources. The types of organic material will include, but not be limited to, greenwaste, paper,
and food; and
WHEREAS, the new procurement will solicit the costs for providing treatment of the
mulch for invasive species before being distributed to the public at the East Hawaii Organics
Facility; and
WHEREAS, each new organic waste diversion procurement will include a proposal for
providing an in-vessel (closed system) compost component for organic materials generated from
specified island sources; and
WHEREAS, the high equipment and operations start-up costs justify a multi-year
commitment to recoup costs and secure reasonable terms for equipment financing. A multi-year
commitment also provides the County the most favorable opportunity for competitive bids; and
WHEREAS, it is in the County's best interest to contract for the operation of one or more
organic waste diversion sites based on an initial multi-year agreement not to exceed ten (10)
years, with two five (5) year renewal options, provided that the contract may include an additional
one (1) year to the initial term for site preparation, mobilization and demobilization; and
WHEREAS, Article X, Section 10-11 of the County Charter requires that any contract,
lease or other obligation requiring payment of funds from the appropriations of a later fiscal year
or more than one fiscal year be approved by resolution; and
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that in accordance with Article X, Section 10-11 of the Hawai`i County Charter,
the Mayor is hereby authorized to enter into one or more ten (10) year contracts, with two five
(5) year renewal options, for services of furnishing and implementing green waste collection
sites in West Hawai`i and/or East Hawai`i for the Department of Environmental Management
and that sufficient funds be budgeted in future fiscal years to cover the anticipated obligation of
the County under the terms of the agreement. The agreement shall include an in-vessel
composting component; may include an additional one (1) year to the initial term for site
preparation, mobilization and demobilization; and provide that all on-site improvements shall
belong to the County upon the expiration of the contract period.
BE IT FURTHER RESOLVED that this authorization shall remain in effect for fifteen
(15) months from the adoption of this resolution.
BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this
resolution to the Mayor, the Director of Environmental Management and the Director of Finance.

A RESOLUTION TO EMBRACE AND ADOPT THE PRINCIPLES OF ZERO
WASTE AS A LONG -TERM GOAL FOR HAWAII COUNTY.
WHEREAS, according to the August 2001 "Waste Composition Study, South Hilo
Lanfill", approximately 67,000 tons of waste was deposited at the South Hilo Landfill in
2000; and
WHEREAS,the department of environmental management secured an extention of
time for the closure of the South Hilo Landfill by implementing sliver-filling techniques
that have added some years to the landfill's life span; and
WHEREAS,the Council of the County of Hawai`i recognizes the need to increase
efforts that will divert materials from the landfill; and
WHEREAS, the Zero Waste philosophy promotes the highest and best use of
materials to eliminate waste and pollution by emphasizing a closed-loop system of
production and consumption, moving in logical increments toward the goal of zero waste
through the core principles of:
• Improving"downstream" reuse/recycle of end-of-life products and materials to
ensure their highest and best use;
• Pursuing"upstream"re-design strategies to reduce the volume and toxicity of
discarded products and materials, and promote low-impact or reduced-consumption
lifestyles;
• Fostering and supporting the use of discarded products and materials to stimulate and
drive local economic and workforce development; and
WHEREAS,strategies to reach zero waste can help promote the over-arching goal of
each generation leaving a reduced ecological footprint on the earth; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that
through its legislation, policies, and actions that Hawai`i County does embrace and will
adopt the Zero Waste philosophy of solid waste management; and
WHEREAS, strategies to reach zero waste can help promote the over-arching goal of
each generation leaving a reduced ecological footprint on the earth; now,therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that
through its legislation, policies, and actions that Hawai`i County shall embrace and adopt
the Zero Waste philosophy of solid waste management and that the Council and the
department of environmental management will take necesssary steps to incorporate the
Zero Waste philosophy into the Integrated Solid Waste Management Plan; and
BE IT FINALLY RESOLVED that the Clerk of the County of Hawai`i transmit
copies of this resolution to the director of the department of environmental management
and to the Mayor of Hawai`i County.

WHEREAS, Contingency Relief funds from Council District 6 will be appropriated to
the Department of Environmental Management to contract a recycling study supporting
Resolution 356-07 which adopted the principals of zero waste, and to develop a plan to
implement recycling and diversion programs to reach the goal of 85% diversion of solid waste
from the waste stream in three years; and
WHEREAS,the Integrated Solid Waste Management Plan will be amended to reflect the

A RESOLUTION URGING THE DIRECTOR OF THE DEPARTMENT OF
ENVIRONMENTAL MANAGEMENT TO DEVELOP AN ORDINANCE AND
IMPLEMENT A PLAN TO PROHIBIT FOOD, PAPER, AND COMPOSTABLE
ORGANICS FROM HAWAII COUNTY LANDFILLS BY 2012.
WHEREAS, landfilling food and paper is greatly contributing to global warming; and
WHEREAS, more than 100 tons of biodegradable materials, including paper products,
food scraps and yard trimmings, are landfilled in the County of Hawai`i every day. These
materials amount to approximately half of our island's discarded resources, and when buried in a
landfill, they decompose without oxygen and generate methane, an efficient atmospheric heat-
trapping gas and a major factor in climate change; and
WHEREAS, methane is understood to be 72 times more potent than carbon dioxide
(CO2) in causing climate changes over a 20-year period,the amount of time scientists have
determined is left before the planet reaches the "tipping point" on irreversible climate change.
Landfills are the number one source of human-caused methane in the United States and emit the
greenhouse gas equivalent of 20 percent of our country's coal-fired power plants every year; and
WHEREAS, commercial farming and shortsighted land use policies favoring
energy-intensive pesticides, fertilizers, and irrigation water have resulted in dramatic increases in
greenhouse gases discharged into the atmosphere for more than 50 years. These practices have
contributed to one-third of the increase in atmospheric CO2, while causing erosion,
sedimentation, water pollution, and the progressive stripping of organic matter, beneficial
microbes, carbon, and other essential nutrients from our soils; and
WHEREAS, healthy soils are capable of holding twice the carbon stocks of plants.
Release of soil bound carbon through tilling, unsustainable and other short sighted farming
practices cause soils to contribute to, rather than protect against, global warming. These
unsustainable methods also compromise the ability of using soil to grow food locally,
nutritiously, and sustainably; and
WHEREAS, Hawai`i currently imports 90 percent of its food and urgently requires
the healthier soils that can be produced through diverting organic materials from the landfill and
returning the nutrients and organic matter back to farmland to grow its own. This is a critical
component of re-creating a more sustainable society on our island; and
WHEREAS,the quickest and cheapest way to immediately reduce our community's
greenhouse gas emissions and improve the health of soils on the island is to divert compostable
organics from our landfills; and

WHEREAS,this resolution is in keeping with'Resolution 356-07, Draft 2;
"EMBRACING AND ADOPTING THE PRINCIPLES OF ZERO WASTE AS A LONG TERM
GOAL FOR HAWAI`I COUNTY", adopted on December 19, 2007; and
WHEREAS,we agree to phase these materials out of our landfills by 2012, and ask
that Department of Environmental Management staff come back with a plan on how to best
accomplish this and how to work with local agencies to encourage the use of compostable
organics to sustain the health of our soils; now,therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAJ`I that
food,paper, and compostable organics shall be banned from Hawai`i County landfills by 2012
and that the Department of Environmental Management is urged to develop a plan to accomplish
this policy and to present it to the Hawai`i County Council within 6 months of passage of this
resolution.
BE IT FURTHER RESOLVED that the County Clerk shall forward a copy of this
'resolution to the Director of the Department of Environmental Management to develop a
strategic plan to achieve the goals in accordance with the terms of this resolution.
