RESOLUTION No. 350 87
WHEREAS, the people of the County of Hawaii acknowledge
that Mauna Lani Resort, Inc., for over fifteen (15) years, has
been developing the Mauna Lani Resort, a master -planned, first
class destination resort community on certain lands located at
Kalahuipua'a, South Kohala, County of Hawaii; and
WHEREAS, the people of the County of Hawaii recognize that
the Mauna Lani Resort, which currently consists of the Mauna
Lani. Bay Hotel, the Mauna Lani Terrace and Mauna Lani Point
condominium projects, a world-renowned championship golf course
and tennis and beach club facilities, has been and is being
developed in compliance with all applicable County -imposed
conditions; and
WHEREAS, pursuant to Change of Zone Ordinance Nos. 380,
607, 608, 908, 85-7 and 87-73 enacted by the County of Hawaii,
Mauna Lani Resort, Inc., is required to provide and make
available a certain number of housing units for the purpose of
providing employee housing for its resort hotel developments;
and
WHEREAS, pursuant to the State Land Use Boundary Amendment
No. A84-583 covering a portion of the project area, Mauna Lani
Resort, Inc., is further required to provide certain housing
opportunities for low and moderate income Hawaii residents,
equal to 10 percent of the number of resort residential units
to develop in that area; and
WHEREAS, the present development scenario of Mauna Lani
Resort, Inc., includes the construction of up to 1,450
additional resort hotel units between 1990 and 1998 and up to
450 resort residential units in the area covered under State
Land Use Boundary Amendment No. A84-583.; and
WHEREAS, Mauna Lani Resort, Inc., is continuing its efforts
to ensure that the Mauna Lani Resort is developed and
maintained in compliance with all County of Hawaii
requirements, including the above -referenced resort employee
housing condition imposed by the County of Hawaii; and
WHEREAS, the people of the County of Hawaii recognize that
Mauna Lani Resort, Inc., is not required to provide any
employee housing units until the completion of the next hotel
in the Mauna Lani Resort, which is estimated to occur around
1990; and
WHEREAS, the people of the County of Hawaii wish to
acknowledge the present efforts of Mauna Lani Resort, Inc., to
meet Its future obligation to provide employee housing in that
Mauna Lani Resort, Inc., is currently in the process of
developing and constructing the La'ilani Housing Project at
Kealakehe, North Kona, consisting of two hundred (200)
multi -family residences, which is also intended for low to
moderate income and gap group families; and
WHEREAS, the people of the County of Hawaii wish to further
acknowledge the efforts of Mauna Lani Resort, Inc., to meet its
future employee housing obligation in that Mauna Lani Resort,
Inc., is also currently negotiating with the Hawaii Housing
Authority and the United States Department of Housing and Urban
Development for the construction of the Noelani II Housing
Project (24 three-bedroom units) under the public housing
program for low income residences in Waimea, South Kohala; and
WHEREAS, the people of the County of Hawaii desire to
recognize the contributions of Mauna Lani Resort, Inc., to the
housing stock available to low and moderate income and gap
group families in the County of Hawaii and Mauna Lani Resort,
Inc.'s, efforts to comply with the resort employee housing
requirement imposed by the County of Hawaii by granting and
giving Mauna Lani Resort, Inc., credit for the housing units
comprising the Noelani II and La'ilani Housing Projects.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that:
1. Employee Housing Requirement. Pursuant to Change of
Zone Ordinance Nos. 380, 607, 608, 908, 85-7 and 87-73 enacted
by this Council, Mauna Lani Resort, Inc., is required to
provide and make available a certain number of housing units
for the purpose of resort employee housing. Ordinance No. 607,
which amended ordinance No. 380, contains the following
pertinent language relating to the housing requirement:
Condition P. "The petitioner shall provide a minimum
of twenty-eight (28) units for the purpose of resort
employee housing for the first hotel prior to the
issuance of the occupancy permit for the first
operational hotel. The manner in which these units
are to be provided shall meet the approval of the
County Council. Resort employee housing for
subsequent hotel development shall be based on
additional housing need studies prepared by the
petitioner. The issuance of preliminary plan approval
of subsequent hotels shall follow the approval of the
housing studies."

Furthermore, pursuant to a condition imposed upon the Mauna
Lani Resort property by the Land Use Commission of the State of
Hawaii, Mauna Lani Resort, Inc., is required to provided
certain housing opportunities for low and moderate income
Hawaii residents and/or employees employed at the Mauna Lani
Resort.
2, Housing Credit. Mauna Lan! Resort, Inc., shall be
granted and given credit for the housing units developed in,
constructed for and comprising the Noelani II and La'ilani
Housing Projects. Therefore, it is hereby recognized that upon
completion of the La'ilani and Noelani II Housing Projects,
said employee housing requirement imposed by the County of
Hawaii pursuant to said Change of Zone Ordinance Nos. 380, 607,
608, 908, 85-7 and 87-73 shall be deemed fully satisfied and
discharged for Mauna Lani Resort, Inc.'s, present development
scenario which includes a maximum of 1,450 additional hotel
resort units and a maximum of 450 resort residential units
within the area covered under State Land Use Boundary Amendment
No. A84-583. This Council hereby urges the State of Hawaii to
likewise recognize that Mauna Lan! Resort, Inc., has satisfied
and discharged its housing requirement imposed by the State
Land Use Commission pursuant to Boundary Amendment No. A84-583.
BE IT FURTHER RESOLVED that the Clerk shall and is hereby
directed to transmit copies of this Resolution to the Land Use
Commission of the State of Hawaii; the Planning Director of the
County of Hawaii; and Mauna Lani Resort, Inc.
