No. 1151/Bill No. 256 (2014-2016) PLACE: Council Chambers Hilo, Hawai`i TIME: 11:45 a.m. Council Chair and Members Hawai`i County Council Hilo, Hawai`i 96720 Your Committee on Planning, to which was referred Bill No. 256 (2014-2016), reports as follows: Bill No. 256 (2014-2016), transmitted by Council Member Dennis "Fresh" Onishi, via Communication No. 1151, dated October 25, 2016, amends Chapter 25, Article 4, Section 25-4-51 of the Hawai`i County Code 1983 (2016 edition, as amended) relating to Off-Street Parking and Loading. This measure would establish required parking spaces for dwellings occupied for less than 180 days. On November 15, 2016, Council Member Onishi explained that he created this bill because of neighborhood parking conflicts that arose from a lack of rules and restrictions for rental occupant parking. Mr. Onishi explained that renters have been parking along neighborhood streets, and that he added language to require on-site parking for occupants that reside in dwellings for 180 days or less. Planning Director Duane Kanuha came forward for questions and responded to Council Member Danny Paleka's inquiry about"how parking is verified." Mr. Kanuha stated that parking stalls are allocated when plans for structures come in. Mr. Kanuha also stated that there are mechanisms in place to find out if there is parking on site. Council Member Margaret Wille stated that for rentals located on a street where parking is available, this would not be an issue. Mr. Onishi responded to Ms. Wille and explained that this bill is for cases when a complaint is made by neighbors regarding parking, so that there will be authority for enforcement. This measure was then referred to the Planning Director and the Windward and Leeward Planning Commissions for recommendations. On April 4, 2017, this measure came back to the Planning Committee together with Communication No. 186 from Mayor Kim, transmitting the favorable recommendations of the Windward and Leeward Planning Commissions, and suggested revisions of the Planning Director. PC Report No. 9 PC-9 Page 2 April 4, 2017 Council Member Sue Lee Loy, as successor to Mr. Onishi, gave an overview of this issue and stated that for subdivisions that were approved in the 70's and 80's, roadways were twelve and fifteen feet wide. She stated that this bill would allow neighborhoods to ensure that parking does not negatively impact narrow roads. Ms. Lee Loy then moved to amend Bill 256 with the contents of Communication No. 186.1, which she explains was created to incorporate the Planning Director's suggestions. Ms. Maija Jackson, a Planner with the Planning Department, came forward and stated that the amendment was identical to the suggestions of the Planning Commissions. She explained that Mr. Onishi's bill did not account for property owners renting out an entire home as a whole to a family, and that this amendment accounts for rental rooms as well as renting entire homes. Ms. Jackson, in response to inquiry by Council Member Richards, stated that this bill may impact people with small lots, although no study has been done. The vote on the motion to amend this bill with the contents of Communication 186.1 was taken, and passed with nine "ayes." The vote was then taken on the motion to approve Bill 256, as amended, and passed with nine"ayes."
