The Leeward Planning Commission forwards its favorable recommendation for this
change of zone, which would allow the applicant to subdivide the property into two
parcels to allow each unit owner to have a separate title and tax map key.

AN ORDINANCE AMENDING CHAPTER 23,ARTICLE 3, DIVISION 4, SECTION
23-41, HAWAII COUNTY CODE 1983 (2016 EDITION,AS AMENDED),RELATING
TO SUBDIVISION STREET DESIGN STANDARDS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. The purpose of this amendment is to reduce the "Minimum Right-of-Way"
width from 50 to 40 feet for minor streets in areas characterized as rural and agricultural in
section 23-41 of the subdivision code. This reduced standard reflects the conditions that
currently exist in many rural subdivisions within Hawai`i County. The minimum right-of-way
standard of 50 feet for minor streets in urban areas is unchanged by this proposal.
SECTION 2. Chapter 23, article 3, division 4, section 23-41, Hawai`i County Code
1983 (2016 Edition, as amended), is amended by amending subsection(a) to read as follows: •
"(a) Unless otherwise indicated on the County general plan, the width of a street in feet
shall not be less than the minimums shown in the following table:

SECTION 3. New material is underscored. In printing this ordinance, the
underscoring need not be included.
SECTION 4. Severability. If any provision of this ordinance, or the application
thereof to any person or circumstance, is held invalid, the invalidity does not affect other
provisions or applications of the ordinance which can be given effect without the invalid
provision or application, and to this end,the provisions of this ordinance are severable.
SECTION 5. This ordinance shall take effect upon its approval.
