The following are the recommendations of the Committee on Planning which
were considered at its meeting of November 29, 1977:

No. 374. 3: VETO OF BILL 337
PARK DEDICATION CODE AMENDMENT
From Mayor Herbert T. Matayoshi dated October 31 , 1977,
informing after careful review of Bill No. 337 and
consultation with the Corporation Counsel, he is
compelled to disapprove and veto said bill, as amended,
and lists reasons.

RULES AND REGULATIONS
From Planning Director Sidney Fuke dated November 22,
1977, submitting for review and approval, the Planning
Department' s Rules and Regulations relating to the
Central Coordinating Agency.
Recommend acceptance of the Rules and
Regulations relating to the Central
Coordinating Agency with the following
recommendations to be discussed at the
Council meeting of December 5, 1977:
1.1, General Provisions, Section 1.4f-
Corporation Counsel be asked to render
an opinion whether or not the "declaratory
ruling" on a question of law is appropriate
to a regulatory body;

or Repeal of Rules, Section 6. 1 -
further clarification as to what
constitutes an interested party for
the purpose of modification of the
rules; and
1. 7, Declaratory Rulings by Agency -
Corporation Counsel to determine whether
it should be deleted from the rules;
1. 7, Section 7. 6, Notification of
Petitioner - whether a specific time
limit should be set as to when the
Director shall inform the applicant
of an action on a petition.

Commission Chairman Lorraine R. Jitchaku dated
November 17, 1977, informing that the Commission shall
act on his application for a planned development
permit not earlier than fifteen days after the duly
advertised public hearing held on November 16, 1977.

From Mayor Frank F. Fasi, City and County of Honolulu,
dated October 21, 1977, transmitting for review, a copy
of letter he sent to Governor George Ariyoshi concerning
the draft of the Hawaii State Plan.

�No. 603 : PROPOSAL FOR MAJOR COMMERCIAL CENTER AT THE
KANOELEHUA-PUAINAKO INTERSECTION
Copy of letter to Messrs. Robert E. Bjerke and Richard. E.
Fahrenwald of REDEVCO from Planning Director Sidney Fuke
dated October 31, 1977, regarding their proposal for a
major commercial center at the Kanoelehua-Puainako
intersection.

No. 603: The area is designated for industrial uses on both
the General Plan and Zoning Maps, therefore, before
the proposal can proceed, the General Plan and
Zoning Map must be amended.
Informs they are presently up-dating the General Plan
and that the proposal, as well as all other thoughts,
will be carefully reviewed.

From Planning Commission Chairman Lorraine R. Jitchaku
dated November 17, 1977, transmitting for adoption a
resolution naming the roadway fronting the Kaimu-Makena
Houselots, located in Kaimu, Puna.
Approve and recommend adoption of
Resolution 191.
ORDINANCE
Bill 337: PARK DEDICATION CODE AMENDMENT
(2nd Amend- Amends Chapter 17, Hawaii County Code, relating to the
ment) provision of land for parks and playgrounds or the
payment of money in lieu thereof, as a condition
precedent to final approval of a subdivision.
(To avoid confusion, Bill 337 has been renumbered to
Bill 362 ) .
Delete "provided that fee as set forth
in Sec. 5, shall be required" from
Article 3, Sec. 1, A, 2 & 7; and
recommend passage of Bill 362 , as
revised, on first reading.
