From Planning Commission Chairman William S. Mielcke
dated September 27, 1978, informing the Planning
Board of Appeals on July 23, 1978 issued a Findings
of Fact, Conclusions of Law and Decision and Order
to sustain the appeal filed by Mr. Antone Mendes
after the Planning Director denied the application
for a change of zone for six acres of land in the
Ahualoa Homesteads, Hamakua, from an Agricultural
5-acre (A-5a) to an Agricultural 3-acre (A-3a)
zoned district. The change of zone application was
forwarded to the Planning Commission with a denial
recommendation by the Planning Director.
Informs the Planning Commission, after a duly held
public hearing on August 3, 1978, voted to send a
favorable recommendation to the Council with the
reasons as outlined in the Mendes letter; however,
the Planning Director is recommending that the
request be denied based on the findings, as listed;
recommends Bill 425 be passed by the Council on first reading and
referred back to Planning Committee.
