Comm. 1299 : CHANGE OF ZONE APPLICATION
(Bill 523) PETITIONER: DR. VICTOR BEN JENSEN
WAIMEA HOMESTEADS, SOUTH KOHALA
(TMK: 6-5-07: 36)
From Planning Commission Chairman William F. Mielcke
dated September 7, 1979 , submitting for adoption, a
bill to change the district classification from an
Agricultural 1-acre (A-la) to a Single Family
Residential - 20 ,000 square foot (RS-20) zoned district
at Waimea Homesteads , South Kohala.
1299 .1: From Douglas Ackerman dated August 31, 1979 , expressing
concern on the rezoning application of Dr. Victor Ben
Jensen.
1299 . 2 : From Kenneth M. Melrose Chairman, Planning & Urban
Design Committee, Waimea-Kawaihae Community Association,
dated September 18, 1979 , informing their association,
at its September 12th meeting, voted unanimously to
request denial of the change of zone application by
Dr. Victor Jensen and transmits copy of a petition
-- opposing the rezoning.
Lw 1299 . 3: From Frank T. Fuchino, President, Waimea-Kawaihae -
Community Association, dated September 21, 1979 ,
requesting denial of the rezoning request , for reasons,
as listed;

recommends the communications be placed on file and that Bill 523
be amended as follows :
(1) Change Condition (E) to Condition (F) ; and
(2) Add a new Condition (E) to read: " (E) prior to issuance of
final subdivision approval ; the subdivider shall enter into an
agreement with the County wherein the subdivider would agree
to : a. contribute $4,000 within six (6) months of the date of
final subdivision approval into a roadand drainage improvement
account for that area, if such an account is established by the
County; or b. make the improvements to the roadway and drainage
systems in that area, meeting with the approval of the Chief
Engineer within one (1) year from the date of final subdivision
approval. "
Further recommends Council approve and adopt Bill 523, as revised,
on first reading.
(Mr. Sameshima declared a possible
conflict of interest and abstained
from voting. )
