Your Committee on Public Works to which was referred:
Comm. 846. 5 : FLASHING RED LIGHTS USED BY SCHOOL BUSES
From Herbert S. Watanabe., District Business
and Facilities Specialist, Department of
Education, dated September 18, 1978 , pointing
out the conflict in Chapter 5, Article 4 , Section
3.12 , Hawaii County Code, and Section 291-C, HRS,
and Chapter 6, Article 7, Section 2B, Hawaii
County Code, or Ordinance 221, relating to
school buses, and requests that this matter be
referred to the legal counsel for review and
clarification.

dated November 29, 1978 , responding to C-846 . 5 .
Informs it would not be appropriate for their
office to make any commentsor recommendations
with respect to the development of that policy;
requests instead that when the Council determines
a policy to implement an ordinance requiring
County-wide use of flashing red lights, they will
then review the proposedlegislation for form
and legality. Informs that Section 3. 12 , Article
4, Chapter 5 , Hawaii County Code, is not in
conflict with Section 291C-95, HRS, because the
County' s provision does not provide for the use
of flashing red lights; .
recommends the communications be placed on file; and a copy of C-846 . 9
be transmitted to Mr. Herbert S. Watanabe for his information.
