Ms. Virginia Goldstein, Director Planning Department COUNTY OF HAWAII ; 25 Aupuni Street Hilo, HI 96720 Dear Ms. Goldstein: Subject: Annual Progress Report (1999) -Big Island Country Club and Estate, Tax Map Key: 7-1-5: Various Based on your letter of April 15, 1997, the next annual report covering Ordinance No. 94-78, Special Permit No. 863, and Use Permit No. 74 relating to the subject project was due on or before July 13, 1998. The last report was submitted on August 18, 1999, and it was assumed that that was the date. I apologize for this oversight. Please also note that the annual report requirement for the proposed lodge (SPP 95- 24) is also due on September 27. Given the relatedness of this project and the proximate due dates, we respectfully request your acceptance of this report to satisfy the annual report requirement for all of the permits covering this project. Use Permit No. 74 This permit covered the construction of a 27-hole golf course. With your acceptance of the developer's community benefits program and the understanding that the channelized intersection and community park would be in place by the end of 1998, a "sob" opening of the first 18-holes commenced during the latter part of December 1997. As the required improvements were not able to be met, the developer requested a time extension as well as certain modifications to the community benefits program. This was approved by the Planning Commission at its meeting of April 1, 1999. The amended conditions require: a. The community recreation and volunteer fire station facilities be completed by December 1, 2000; and b. The proposed 10+_ acre community park be subdivided and conveyed to the Community Association within six months from the effective date of the amendment to Ordinance No. 94-78. The effective date of this ordinance is q, ~.u'i~f",. ~-,y. Ms. Virginia Goldstein August 25, 1999 Page 2 June 23, 1999, and as a result, the park must be conveyed before December 23, 1999. According to information provided me by the applicant's president, Ms. Noriko Saiga, the delay in fulfilling these commitments is attributable to the time needed to secure the required financing. At this stage, the prospective lender has required an appraisal of the property, and said appraisal is nearing completion. Ms. Saiga believes that the financing component should be finalized within the next 3 months. Under that basis, construction of certain activities can begin in February or Mazch of the yeaz 2000. In the meantime, a surveyor has been retained to proceed with the prepazation of the proposed consolidation/resubdivisionrnaps to allow for the subdivision of the 10+_ acre parcel. It is hoped that this application will be filed in September and that final approval can occur before the end of the year. That would make it possible for the applicant to fulfill the pazk conveyance requirement. Special Permit No. 863 This permit relates to the expanded use of the golf clubhouse and the community park. A time extension for completion of the pazk and clubhouse was approved by the Planning Commission at its meeting of April 1, 1999. Said extension required completion of the community park by December 1, 2000. Over the past year, work on the clubhouse and the community park has been suspended due to the lack of funds. Should the pending loan be approved, the applicant believes that this requirement can be fulfilled. Ordinance No. 94 78 This ordinance allowed the creation of up to 100 1-acre lots. There were also conditions that required provision of the community pazk, similar to the terms of the Use Permit. As such, Ordinance No. 99 79, which became effective on June 23, 1999, essentially granted a similar time extension for conveyance of the community pazk and completion of the park improvements. Relative to the subdivision itself, tentative subdivision approval has already been granted. It was hoped that final approval for the first phase covering approximately 601ots would have been secured eazly part of this yeaz. However, because of financing, the project Ms. Virginia Goldstein, Director August 25, 1999 Page 3 was put on hold. Like the balance ofthe project, this aspect will get re-started upon receipt of the pending loan; and construction should begin in the first quarter of 2000. Special Permit No. 95-24 Although the Commission's decision was appealed, the appellants and the applicant reached an agreement on June 25, 1998. This technically cleared the way for construction of the proposed lodge. Like the balance of the project, however, this project, too, was affected by the applicant's financial circumstances. The applicant still has every intention of pursuing this project and would like to see it completed within the next two years. We trust that the foregoing adequately addresses the annual report requirement. If not or if there are further questions on this matter, please feel free to contact me.
