Change of Zone Ordinance No. 99-79 (REZ 767)
Use Permit No. 74
Applicant: Big Island Country Club & Estates

This is in response to your letter dated December 27, 1999, requesting an administrative
extension oftime to Condition M(1) of Ordinance No. 99-79 and to Condition No. 4(a) of Use
Permit No. 74. We shall process the amendment to Use Permit No. 74 under separate cover as it
requires a public hearing.
Ordinance No. 99-79 requires that the applicant subdivide and convey approximately 10 acres to
the Pu'uanahulu Community Association or designee for the development of a community park
within six (6) months of the effective date of the ordinance or by December 23, 1999.
You have explained that the applicant is in the process of complying with this requirement and
has secured tentative approval. Additional time is needed to secure final subdivision approval
and to convey, record, and title search the property.
Based on your request, the Planning Director has determined that non-compliance with this
condition is beyond the control of the applicant, would not be contrary to the General Plan or the
original reasons for approving the request. You are hereby granted a six (6) month
administrative extension until June 23, 2000 to complete the process.

Dear Ms. Goldstein:
Subject: Request for Time Extensions - UP 74 and Ord. 99-79
Rio Island County Club & Estates
As you aze aware, amendments to conditions of the referenced Use Permit and
Ordinance required Big Island Country Club & Estates to convey the 10 acre park to the
community before the end of the yeaz. Unfortunately, this will not be possible.
The effective date of the amendment to the zoning ordinance was June 23, 1999. The
subdivision application was then filed on September 29, 1999. Tentative approval was
granted on December 10, 1999, subject to a number of conditions. These conditions are now
being worked upon, and the final plat map with the letter of staking should be forthcoming
within the next week.
Subsequent to issuance of final subdivision approval, the property must still be
recorded with the State Bureau of Conveyances. The appropriate conveyance document
must also be prepared and then submitted to the Pu'uanahulu Community Association. A title
search of the area to be conveyed will also have to be undertaken to assure that there are no
liens or encumbrances on the area to be conveyed. We believe that these can occur within
the next 60 days. In the meantime and in the interest of good faith, the applicant will be
forwarding a draft of the conveyance document to the Association for its review. This draft
is being worked upon by Mr. Ben Tsukazaki.
In view of the foregoing and pursuant to condition V of Ordinance No. 99-79, a 60
day extension is being requested.
We note that the Use Permit does not allow for any administrative extension. As
such, the applicant requests an amendment to Condition 4(a) of Use Permit by allowing a 60-
day time extension to February 23, 2000. We believe that said extension would enable the
applicant to fulfill the mandate of this condition. The required filing fee of $250 is enclosed.
Further, we will be sending a notice of this matter to the affected surrounding property
owners before January 7, 2000.
