Change of Zone Ordinance No. 92 123 as amended by Ordinance No. 97 65 (REZ 728)

Subject: Request for Administrative Time Extension

This is to acknowledge receipt of your letter dated March 19, 1999 requesting an extension of
time to Condition B of the above-referenced ordinance.
Condition B of the amended ordinance states in part that Final Subdivision Approval shall be
secured within two years from the effective date of the above-referenced ordinance, or May 14,
1999.
You have indicated that the request for a time extension has been brought about by the inability to
obtain financing for the development due to the depressed state of the Big Island economy. It is
our further understanding that because of the inability to obtain financing, requirements within the
conditions of approval cannot be satisfied on a timely basis.
Condition L of the approved change of zone ordinance allows the Planning Director to grant an
extension of time for performance of conditions within the ordinance. We have determined that
non-performance is a result of circumstances beyond the applicant's control and not a result of
fault or negligence, and hereby grants a two year extension of time until May 14, 2001 to comply
with Condition B.

Please be aware that should you request an additional extension of time, your request must be
forwarded to the Planning Commission through this office. A $250 Sling fee, original and twenty
copies of the request shall be submitted when requesting an additional extension of time. A pubfic
hearing to consider your request will be held within 120 days. After such a hearing is conducted,
the request and the Commission's recommendation will be forwarded to the County Council.
As a reminder, you are required to comply with all conditions as stated in the above-referenced
ordinance within their appropriate timetables.

Dear Ms Goldstein,
The above described change of Zoning Ordinance applies to a 45.945 acre parcel in the Kurtistown
Area. We have continually tried to obtain financing for the development but due to the depressed
state of the Big Island economy, lenders have not been financing this type of development. This
financing crisis has made it impossible for us to meet time requirements imposed our development
at this time.
We hereby request an extension of our change of zone application. We will look forward to your
response.
