Your Committee on Public Works, to which was referred Communication
1609 and Resolution No. 920-84, reports as follows:
Communication 1609 is a transmittal letter from the Chief Engineer
submitting for consideration and adoption, Resolution No. 920-84
which authorizes the County of Hawaii to condemn property by eminent
domain proceedings for purposes in connection with the Federally
funded Pahoa-Kapoho Road Improvement Project, Phase II.
Communication 1609 advises that the County of Hawaii is experiencing
difficulty in acquiring a portion of TMK: 1-5-115 :45 for/ the project
because one of the owners of the property is incapacitated and cannot
enter into a contract with the County of Hawaii . In view of this
shortcoming and the fact that the incapacitated tenent does not have
a legal guardian, condemnation by eminent domain is being recommended.
Your Committee on Public Works concurs with the recommendation of the
Chief Engineer and recommends adoption of R- olution No. 920-84.
