SUBJECT: Proposed Amendment to Bill No. 47, A.Bill for an Ordinance
Amending Chapter 15, Article 9, of the Hawai`i County Code 1983
(2016 Edition, as Amended), Relating to Farmers Markets.
Please see below a proposed amendment to Bill No. 47. This amendments is illustrated below in
Ramseyer format with respect to the contents of Bill No. 47. Material to be deleted is bracketed
and stricken and material to be added is underscored. A draft copy of proposed Bill No. 47, Draft
2, is attached with the amendments incorporated therein.
SECTION 1 of Bill No. 47, is amended to read as follows:
"SECTION 1. Chapter 15, article 9, section 15-72, of the Hawai`i County Code 1983
(2016 Edition, as amended) is amended to read as follows:
"Section 15-72. Farmers market facility schedule.
Farmers markets at County parks and facilities shall be designated by ordinance and
included within the following schedule:

AN ORDINANCE AMENDING CHAPTER 15,ARTICLE 9, OF THE HAWAII
COUNTY CODE 1983 (2016 EDITION,AS AMENDED),RELATING TO FARMERS
MARKETS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 15, article 9, section 15-72, of the Hawai`i County Code 1983
(2016 Edition, as amended) is amended to read as follows:
"Section 15-72. [ .] Farmers market facility schedule.
(a) Waimea.
(b) Kona.
(c) Honokaa County Park Complex.]
Farmers markets at County parks and facilities shall be designated by
ordinance and included within the following schedule:
Farmers Markets
Hilo/Hamakua
Hakalau Veterans Park
Ka`u
Kohala
Kona
Puna
Pahoa Neighborhood Facility
Pahoa Regional Park
Volcano Park"

SECTION 2. Chapter 15, article 9, section 15-73, of the Hawai`i County Code 1983
(2016 Edition, as amended) is amended by amending subsection(c)to read as follows:
"(c) Permit fees may be used by the department to enter into [a purchase of services
contract] an agreement with a nonprofit organization[for the administration and
management of] to administer and manage a farmers market program and/or site."
SECTION 3. Material to be repealed is bracketed and stricken. New material is
underscored. In printing this ordinance, the brackets, bracketed and stricken material, and
underscoring need not be included.
SECTION 4. Severability. If any provision of this ordinance, or the application
thereof to any person or circumstance, is held invalid,the invalidity does not affect other
provisions or applications of the ordinance that can be given effect without the invalid
provision or application, and to this end the provisions of this ordinance are severable.
SECTION 5. This ordinance shall take effect upon approval.
