No. 333/Bill No. 49 Your Committee on Planning, to which was referred Bill No. 49, reports as follows: Bill No. 49, transmitted by Mayor Harry Kim, via Communication No. 333, dated June 15, 2017, amends Chapter 25, Article 1, Article 2, Article 4, Article 5, and Article 7 of the Hawaii County Code 1983 (2016 Edition, as amended), Relating to Zoning District Regulations for Meeting Facilities and Community Buildings. Mayor Kim forwarded the Windward and Leeward Planning Commissions' favorable recommendation for this amendment to the Zoning Code, which would remove all references to community buildings, amend the definition of meeting facility, and identify what zoning districts require a special permit or a use permit to allow for a meeting facility. Chair Eoff explained that there were structural problems with the bill as submitted, and that she wanted to introduce Communication No. 333.1 prior to discussion on the bill. Deputy Planning Director Daryn Arai was present in Hilo Chambers. Mr. Arai apologized for the mistakes in ramseyering that resulted in a bill not being structurally defined. He stated that the contents of Communication No. 333.1 contains the proper version of this bill. The vote was taken on a motion to amend Bill 49 with the contents of Communication No. 333.1, and passed with eight ayes. Council Member Aaron Chung was not present at this meeting. Mr. Arai explained that their intention in this bill, as amended, was to make clear, and combine the definitions for meeting facilities and community buildings. In response to several inquiries from Council Members, Mr. Arai stated that amendments to the Planning Department's Rules and Procedures were not necessary, and that this bill was aligned with existing processes. He also said that in addition to processing applications, the Planning Department is cleaning up the "foundation" wherever problems arise with applications of the County Code. Several Council Members expressed favor for this bill, as amended, and the vote was taken.
