Bill 57: AMENDS CHAPTER 24, ARTICLE 11, OF THE HAWAII COUNTY CODE
1983 (2016 EDITION, AS AMENDED), BY ADDING NEW DIVISIONS AND
ESTABLISHING A NO PARKING ZONE ON WAI`OPAE ROAD
Establishes a new section in the County Code to prohibit parking at anytime on
certain private streets, and adds a portion of Wai`opae Road, as located in Puna, to
this new section.

ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 24,ARTICLE 11, OF THE HAWAII
COUNTY CODE 1983 (2016 EDITION,AS AMENDED), BY ADDING NEW DIVISIONS
AND ESTABLISHING A NO PARKING ZONE ON WAI`OPAE ROAD.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. The purpose of this amendment is to establish a no parking zone on a
portion of Wai`opae Road, in order to enable the police to enforce parking restrictions in this
area. Pursuant to section 46-16, Hawai`i Revised Statutes and section 24-2 of the Code,the
Council finds that this private street has been in continuous use by the general public for more
than six months and consequently is subject to the provisions of the Hawai`i County traffic code.
Further, pursuant to section 46-16, Hawai`i Revised Statutes and section 24-2 of the Code, the
County shall not become responsible for the maintenance and repair of this private street,
highway, or thoroughfare as a result of: the imposition or enforcement of this traffic regulation or
highway safety law; or the placement of, or the County's permitting to be placed, appropriate
traffic control devices on this private street, highway, or thoroughfare.
SECTION 2. Chapter 24, article 11, of the Hawai`i County Code 1983 (2016 Edition, as
amended), is amended by adding new divisions to be numbered: 3; 4, 6, 7, 8, 9, and 10 and to
read as follows:
"Division 3. Reserved.
Division 4. Pedestrians.
Division 6. Loading Zones.
Division 7. Reserved.
Division 8. Restrictions on Certain Vehicles.
Division 9. Bicycles.
Division 10. Tow or Tow-Away Zones."
SECTION 3. Chapter 24, article 11, of the Hawai`i County Code 1983 (2016 Edition, as
amended), is amended by adding a new division 5, to be entitled"Parking." The Code shall
further be amended by adding a new section to be placed within this division 5, appropriately
designated, and entitled, "Schedule 28. No parking at anytime." This new division and section
will read as follows:
"Division 5. Parking.
Section 24- . Schedule 28. No parking at anytime.
When signs are erected giving notice thereof, no person shall at anv time park a vehicle
upon any of the following described streets or portion of streets:
(a) Hamakua
(b). North Hilo
(c) South Hilo
(d) Ka`u
(e) Kohala
(f) Kona
(g) Puna
• Wai`opae Road, makai side, from Kapoho Kai Drive to Kaheka Road."
SECTION 4. New material is underscored. In printing this ordinance, the underscoring
need not be included.
SECTION 5. Severability. If any provision of this ordinance, or the application thereof
to any person or circumstance, is held invalid,the invalidity does not affect other provisions or
applications of the ordinance that can be given effect without the invalid provision or
application, and to this end the provisions of this ordinance are severable.
SECTION 6. This ordinance shall take effect upon its approval.
