Your Committee on Planning to vhich was referred:
Bill 689 : NUCLEAR ENERGY
(REVISED) An ordinance amending Chapter ance Cha ter 3 of the Hawaii County Code,
as amended, by adding a new article relating to nuclear
energy;
(Intr. by: Miss Lai, Messrs. Dahlberg & Kawahara)
recommends Revised Bill 689 be amended as follows :
(1) Subsection 1 of Section 2 , Definitions, under Section 1 to read:
"Radiation sources or materials employed in therapeutic radiology,
in biomedical research, or in educational endeavors, or medical
devices designed for individual application (as for example cardiac
pacemakers) [ . ] or commercial devices for treatment of products , as
approved by the Departments of Health and Agriculture. "
(2) Section 6, Penalty, under Section 1, be amended to read: "Any
person violating any provision of this ordinance shall be guilty
of a [felony] misdemeanor and shall be fined not [less] more
than [Ten Thousand Dollars ($10 , 000) ] One Thousand Dollars ($1, 000)
or imprisoned for not [less] more than [ten (10) years] one (1)
year, or both, for each violation. " (Pursuant to Section 13-11 ,
Penalties, of the County Charter. )
Further recommends Council approve and adopt Bill 689 , as amended, on
second and final reading.
