Your Committee on Planning to which was referred:
Bill 720 : EXCEPTIONAL TREES
(C-101) Amends Chapter 3 of the Hawaii County Code to add
a new article relating to Exceptional Trees;
recommends Bill 720 be amended by deleting the following Item (d)
from Section 5. Procedures:
"If the property owner or lessee disagrees with the County Council ,
the property owner or lessee may appeal to the Third Circuit_ Court within
thirty (30) days. "
The reasons for deleting said item, as recommended by the Corporation
Counsel, are:
1. Conferring jurisdiction in the circuit courts which does not other-
wise exist; and
2. That it might imply that the County encourages lawsuits against
itself.
It is further recommended that Bill 720 , as amended, be adopted by
the Council on second and final reading.
