(Bill 871) AGRICULTURAL PARK
KAAUHUHU, NORTH KOHALA
TMK: 5-5-01: 22 (37. 86 acres)
From Planning Commission Chairman Alfredo Orita dated
July 13 , 1982, submitting for adoption, a proposed bill
to change the district classification from Agricultural
20-acre (A-20a) to an Agricultural 5-acre (A-5a) zoned
district at Kaauhuhu Homesteads, Kaauhuhu, North Kohala.
894. 1: From Planning Committee Chairman Takashi Domingo dated
July 22 , 1982, submitting for consideration, amendments
to Bill 871 to insure substantial ag performance and
use on several parcels before rezoning can occur on
the remaining parcels;
recommends Conditions (C) and (D) under Section 1 of Revised Bill 871
be amended to read as follows : " (C) that the zoning of the successive
increment (s) shallbecome effective upon subdivision of the previous
increment and [it shall be demonstrated to the satisfaction of the
Planning Director that substantial] agricultural activity [is] being
conducted on at least [90%] 25% of [each] the lots in the preceding
increment. For the purpose of this condition "agriculture" shall be
defined as the cultivations of crops, including but not limited to
flowers, vegetables, foliage, fruits, forage and timber; game propogation;
raising of livestock,:' including but not limited to poultry, bees, fish or
other animal or aquatic life that are propagated for economic or personal
use.. An agricultural activity will be considered [substantial] appropriate
(1) if such activity is implementing a conservation program for the
affected property (ies) , as approved by the applicable soil and water
conservation district directors and filed with the Soil Conservation
Service; or (2) if it provides a major source of income to the person (s)

who reside on the property; or (3) if the property is dedicated for
agriculture uses in accordance with applicable Tax Department
procedures and that such agriculture dedication shall be made a deed
covenant and duly recorded with the Planning Department and Bureau of
Conveyances. [The execution of a Farm Dwelling Agreement may also
suffice in lieu of the above requirements] ; (D) that tentative approval
of subdivision plans shall be [secured] submitted within two (2) years
from the effective date of this ordinance and final subdivision approval
be [secured] submitted within one (1) year thereafter. Tentative sub-
division approval of successive increment (s) be secured within one (1)
year from the effective date of the zoning for that increment. Final
subdivision approval shall be sdcured within two (2) years thereafter; "
Further recommends Bill 871, Revised II, be passed by the Council on
first reading .
