SUBJECT: Resolution 77-99
After reviewing Resolution 77-99, Mayor Yamashiro expressed that
he would prefer to have a resolution from the Council that is a
broad policy statement. There are at least fourteen other
projects with housing conditions that have not yet been
satisfied. The Mayor wants to implement Ordinance 98-1 in a
consistent manner. Resolution 77-99 sets a precedent for a
case-by-case approach to cancel unsatisfied obligations.
Attached is a request from Ms. Pisicchio to waive the action from
the Hawaii County Housing Agency to the full Council. Also
attached is a resolution drafted by the Corporation Counsel's
office that establishes a policy and that is consistent with
Ordinance 98-1.
If the Council is able to hear and approve the attached
resolution at its May 5th Council meeting it would still be
posssible to meet Ka'upulehu Makai Development's timeframe.

SUBJECT: Resolution authorizing the Mayor to execute
cancellations of previous agreements regarding
Affordable Housing Conditions Pursuant to
Ordinance 98-1
Pursuant to Section 1(e) of Rule 9 of the Rules of Procedure of
the Council of the County of Hawaii, this written request is
submitted with my approval that the above-referenced matter be
waived from the Housing Agency to the full Council for immediate
action. However, in the event this request is denied, for
whatever reason, I understand the matter shall be referred to
the Housing Agency for placement on its future agenda.
