Your Committee on Planning makes reference to Communication 1545
requesting the adoption of a resolution to reject portions of
Volume I of the Final Report of the Native Hawaiians Study Commission.
The purpose of this resolution is to urge the United States Senate
Committee on Energy and Natural Resources and the Committee on
Interior and Insular Affairs of the United States House to formally
reject portions of the Final Report of the Native Hawaiians Study '.
Commission, Volume I .
Volume I reflects and incorporates fundamental misinterpretations of
the history: of Hawaii, misapplies American Indian law .to the Native
Hawaiian experience, forces legal analyses which' jeopardize the whole
body of claims and settlement precedents as appropriate remedies for
past wrongs', and denies the fundamental precept of justice through
law. These misrepresented findings should be corrected in national
records for possible future determinations of fact or action by the
national government.
Your Committee on Planning concurs with the rejection of portions of
VolumeI , the Final Report of the Native Hawaiians Study Commission,
and recommends the adoption of Resolution No. 880-84 .
The above action was adopted at the Committee meeting of
April 11, 1984 by the following vote:
