Your Committee on Planning, to which was referred Resolution 941-84
regarding Council ' s initiation of zoning code amendments , reports as
follows:
The purpose of this resolution is to initiate an amendment to
Section 25-20 of the Hawaii County Code which would limit the
Planning Director 's authority to recommend approval or denial on
district classifications to the Planning Commission, and to direct
the Planning Director to prepare the appropriate amendment to
accomplish this purpose. Section 25-19 authorizes the Council to
initiate amendments.
Section 5-4.2 of the Hawaii County Charter limits the Planning
Director to make recommendations on district classifications to the
Planning Commission. Your committee finds inconsistencies in the
zoning code enabling the Director to deny a proposed amendment .
Section 25-18 of the Hawaii County Code allows Chapter 25 to be
amended by changing the boundaries of districts or by changing any
other provision within the chapter whenever the public necessity and
convenience and the general welfare warrants such action. Concerns
were raised on the legality of this issue; however, the Planning
Director has assured your committee that the Planning Commission and
the Corporation Counsel will be consulted.
Your Committee on Planning concurs with Resolution 941-84 and
recommends its adoption.
