Your Committee on Planning, to which was referred Bill No. 1104
regarding the rezoning request of Mauna Kea Properties, Inc. ,
TMK: 6-2-02 :18, 19, and portions of 4 and 13, reports as follows :
The purpose of this bill is to change the district classification
from an Agricultural 1-acre (A-la) and Open (0) to Multiple Family
Residential - 20,000 square feet (RM-20) , Resort-Hotel - 1, 250 square
feet (V-1.25) and Open (0) at Ouli , South Kohala, Hawaii . The
rezoning request involves changing the district classifications of:
(1) the golf course from an A-la to Open zoned district, placing the
golf course in a proper zoning classification; (2)portions of the
hotel grounds, public shoreline facilities, and office building from
an Open to V-1.25 zoned district to accommodate possible future use
for support facilities, as a restaurant, beach club, or other
recreational facilities; ( 3 ) a portion of the residential development
site from an Open to RM-20 zoned district; and (4) a portion of the
residential development site from an A-la to RM-20 zoned district.
The petitioner intends to construct a low density luxury condominium
development of single family and duplex resort-residential units .
The proposed project will be referred to as "The Estates at Mauna
Kea" . Proposed are three single family residential structures and
twelve duplex structures. Other proposed on- and off-site
improvements include landscaping, removal of top soil from the
property or from other areas within the petitioners ' properties,
construction of roadways, and other related improvements. The
petitioner also intends to consolidate and resubdivide some of the
affected properties .
The General Plan identifies the Kawaihae-Hapuna area as a major
resort area. A major resort area is defined as a self-contained
resort destination area provided with basic and support facilities
for the needs of the entire development. The Club at Mauna Kea

includes the Mauna Kea Beach Hotel; the 33-lot Fairways at Mauna Kea
South and the 32-lot Fairways at Mauna Kea North Subdivisions; the
40-unit Villas Condominium project; and 18-hole golf course; tennis
courts and other recreational amenities. The areas requested to be
rezoned will be integrated as part of the existing developments, and
will fulfill the objective of creating a major resort destination
area at this section of South Kohala.
Discussion took place on whether the density should be restricted to
the specific proposal or should it be tied in to the applicable
zoning designation. The proposal calls for 27 units to be spread
over 60+ acres . The zoning designation allows for 112 possible
units. Your committee agreed that the Council should be passing laws
applicable to general situations and not legislate zoning by a
parcel-by-parcel basis .
Your Committee on Planning is in accord with the intent and purpose
of Bill No. 1104 and recommends that it pass first reading.
