Your Committee on Planning, to which was referred Bill No. 1081,
Draft 2, entitled: "An Ordinance Amending Chapter 25 ( Zoning Code) ,
of the Hawaii County Code 1983 , As Amended, Relating to Use Permits, "
reports as follows :
The purpose of this bill is to consolidate all uses requiring a use
permit from the Planning Commission, under Division 5 (Use Permits) ,
Article 1, and place responsibility upon the developer to insure that
the use activity does not infringe upon the surrounding properties .
The bill proposes the following:
1. Repeals Section 25-46 relating to conditionally permitted
uses and transfers it to the proposed use permit
Section 25-28.
2. Repeals Section 25-48 relating to keeping of animals
within the RS, RD, and RM districts and transfers it to
the proposed use permit Section 25-28 .
3. Repeals Section 25-208(a) (10) relating to quarry and
related activities within the general industrial (MG)
district since quarries are required a use permit under
the proposed use permit Section 25-28( 7) .
4. Repeals Section 25-221(b) (1 ) and (2) relating to public
dumps, junkyards, etc. , within limited industrial (ML)
districts and transfers it to the proposed use permit
Section 25-28 .
5 . Restructures Section 25-28 relating to allowable uses for
a use permit, into a chart.
6 . Reduces the minimum lot area from 1 acre to 15 ,000 square
feet in RS, RD, RM and RA districts for the following
uses: medical and dental facilities, religious
institutions , and public and private schools .

7 . Clarifies the procedures for the submission of a use
permit application, and the grounds for review of such
requests.
8 . Amends the use permit procedures where the planning
commission has sixty days to render a decision or the
application be considered denied, to an automatic.
approval.
Your committee has further amended the minimum lot area to
10 ,000 square feet in RS, RD, RM and RA districts for the following
uses: medical and dental facilities, religious institutions, and
public and private schools . This is to accommodate properties in the
Kona area which have 10,000 square feet lots.
Your Committee on Planning is in accord with the intent and purpose
of Bill No. 1081, Draft 3, as amended, and recommends that it pass
second and final reading.
