Your Committee on Planning, to which was referred Bill No. 1124,
entitled: "An Ordinance Amending Section 25-212, Article 15 and
Section 25-220, Article 16, Chapter 25 ( Zoning Code) of the Hawaii
County Code 1983, As Amended, Relating to Minimum Yard Requirements
Within the General and Limited Industrial Zoned Districts" , reports
as follows:
The purpose of this bill is to remove the rear yard setback
requirement for General Industrial (MG) and Limited Industrial (ML)
zoned districts. In situations where an industrial zoned lotabuts
another zoned district, setbacks may be imposed to alleviate any
adverse impact, through the plan approval process.
Industrial buildings are normally constructed with firewalls and do
not necessarily need the additional space to prevent fire hazards .
Thus , removing the rear yard setback requirement of 20 and 15 feet,
as stipulated within the general and limited industrial districts,
would be more conducive for industrial activities . The deletion of
rear yard setbacks is similar to the concepts of Office Commercial
(CO) and General Commercial (CG) zoned districts which provide an
option of a front or rear yard setback .
Your Committee on Planning is in accord with the intent and purpose
of Bill No. 1124 and recommends that it pass first reading.
