Your Committee on Planning, to which was referred Bill No. 1128,
entitled: "An Ordinance Amending Section 25-66(a) , Division 10,
Article 1, Chapter 25 ( Zoning Code) of the Hawaii County Code 1983,
As Amended, Relating to Yard Projections and Open Space" , reports as
follows :
The purpose of this bill is to eliminate a discrepancy in the Code
regarding structural projections extending into a setback area.
The present code states that the structural projection (eaves,
porches , etc. ) may extend four and five feet into the setback area
for a structure requiring a setback of ten feet. This bill amends
this contradiction by allowing structural projections to extend four
feet into the setback area if the required structural setback to the
property line is less than ten feet. The projection may extend five
feet into the setback area if the required structural setback is ten
to fifteen feet .
Your Committee on Planning is in accord with the intent and purpose
of Bill No. 1128 and recommends that it pass first reading.
