Relating to Cancellation of Affordable Housing Agreements
For your consideration, I am forwarding Draft 2 of Resolution No. 80-99 relating to the
cancellation of affordable housing agreements. Draft 2 is being proposed to more closely
track the language contained in Ordinance No. 98-1. These amendments should clarify
the Council's policy, which is to authorize the cancellation of affordable housing
agreements upon (1) the reassessment of an affordable housing plan initiated by an
authorized person or entity; (2) its approval by the County Housing Agency; and
(3) adoption of a resolution authorizing the mayor to negotiate and execute a new
agreement.

RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE CANCELLATIONS OF
PREVIOUS AGREEMENTS REGARDING AFFORDABLE HOUSING CONDITIONS
PURSUANT TO ORDINANCE 98-1.
WHEREAS, the County of Hawaii has established an affordable housing policy in
Ordinance No. 98-1; and
WHEREAS, said ordinance establishes by law an affordable housing policy in
furtherance of the Hawaii County General Plan's goals and policies; and
WHEREAS, the policy set forth in Ordinance No. 98-1 supersedes all previous affordable
housing requirements; and
WHEREAS, any affordable housing condition or portion thereof which had been
established in prior rezoning ordinances and which have not been fully satisfied as of
January 7, 1998, the effective date of Ordinance No. 98-1, may be reassessed upon the initiation
of the person or entity which is legally required to satisfy such condition pursuant to Ordinance
No. 98-1; and
WHEREAS, existing housing agreements, which are determined to be not fully satisfied
and which are based upon affordable housing conditions, that aze reassessed by the County
Housing Agency pursuant to Ordinance No. 98-1 need to be cancelled[;]_
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that the Mayor is hereby authorized to sign such cancellation agreements as may be
entered into by the County of Hawaii pursuant to County Council resolutions authorizing the
Mayor to negotiate and execute certain affordable housing agreements which result from the
reassessment procedure and Ordinance No. 98-1.
BE IT FINALLY RESOLVED that a copy ofthis resolution be transmitted by the County
Clerk to Mayor Stephen K. Yamashiro and Assistant Housing Administrator Ed Taira.
