Your Committee on Finance, to which was referred Bill 1088 which adds
a new section to the Hawaii County Code, Section 2-91.2, relating to
ethics and post-employment, reports as follows :
The purpose of Bill 1088 is to: 1) forbid the misuse of confidential
information; and 2) forbid, for a period of one year after
termination, former Hawaii County officers and employees from
assisting and being compensated by private interests for work related
to specific matters that he/she was associated with during the course
of duty with the County.
Article XIV, Hawaii State Constitution, requires each county to have
a provision relating to post-employment as part of its code of
ethics . All counties, except Hawaii County, have such a provision.
Bill No. 1088 establishes such a section and is similar to the laws
regulating former officers and employees of the State and other
counties .
Your committee amended Bill 1088 by deleting Section 2-91.2(d) which
required officers and employees to report any violation by former
officers and employees .
Your Committee on Finance concurs with the intent of Bill 1088,
Draft 2, and recommends that it pass first reading.
