Your Committee on Finance, to which was referred Bill No. 1134,
relating to lobbyist registration, reports as follows:
The purpose of Bill No. 1134 is to amend Chapter 2, Article 15 ,
Hawaii County Code , by adding a new section, Section 2-91 .3 , relating
to lobbyist registration.
Article 14, Hawaii State Constitution, requires counties to adopt
provisions on lobbyist registration as a part of its code of ethics .
Bill No. 1134 fulfills the requirements of this constitutional
mandate .
Bill No. 1134 defines a lobbyist as "any individual engaged for pay
or other consideration who spends more than five hours in any month
or $275 in any six-month period for the purpose of attempting to
influence legislative or administrative action by communicating or
urging others to communicate with public officials" . Lobbyists are
required to register with the County Clerk and file statements of
expenditures bi-annually. Anyone who wilfully fails to comply with
the requirements of this section will be guilty of a petty
misdemeanor . This bill also enumerates situations under which the
lobbyist registration provisions do not apply.
Your committee has made technical amendments to the bill as follows :
1) Changed the word "legislature" to "council" in
subsection (b) (5) (A) on page 4.
2) Changed the starting date of the second filing period from
June 30 to July 1 in subsection (d) on page 5 .
3) Changed references from "chapter" to "section" in
sections (b) ( 5) , (e ) , and (h) on pages 4, 7 , and 8
respectively.
