HomeMy WebLinkAboutREP FC 239 12/03/1986 1984-1988 1111 REPORT OF THE COMMITTEE ON FINANCE • Date: November 24, 1986 Re: Comm. 819 Place: Councilroom Time: 10 :30 a.m. Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Finance, to which was referred Bill 269, reports as follows : Bill 269 proposes to amend Ordinance 86-63, the Operating Budget for Fiscal Year 1986-87, by increasing the General Fund Fund Balance from Previous Year by 1311, 927 .57 and appropriating same to the Disaster Real Property Claims . The purpose of Bill 269 is to reimburse 64 claimants, certified by the Natural Disaster Claim Commission, as being entitled to tax relief due to prolonged drought periods from 1983 through 1985. The actual amount of relief allowable, based upon taxes paid, amount to 11 .1 million; however, the County and State have not agreed as to which governmental agency is responsible under Chapter 234, HRS, to refund taxes to certified claimants of the 1983-85 drought. The State has refunded 344, 533.01 in excise taxes to the claimants and has referred the claimants to the County for the remainder . The County has determined the initial real property tax refund available to be 1311,927 .57 . Claimants are also entitled to two additional years of tax credits . It should be noted that Corporation Counsel has issued an opinion that all tax relief is the responsibility of the State.
