Subject: Bill for an Ordinance Amending Hawaii County Water Use and Development
Plan to Include Provisions for the Keauhou Aquifer System, Pursuant to Section 29-3
of the Hawaii County Code 1983 (2016 Edition, as amended)
Enclosed is a Bill for an Ordinance to amend the Hawa`i County Water Use and Development Plan
("WUDP"), last updated by Ordinance No. 11-7, effective February 8, 2011. The 2010 WUDP utilized
a broader, island-wide approach in determining allocation to land use amounts. Pursuant to the State
Water Code, Chapter 174C, Hawai`i Revised Statutes ("HRS"), the 2010 WUDP identified the
Keauhou Aquifer System of North Kona as warranting further study to ensure that anticipated demands
of future development projects, including those identified in the Kona Community Development Plan,
would be considered.
On May 27, 2014, the-Water Board, in partial response to the Department of Water Supply's
("Department") review of the Kona Community Development Plan("CDP"), authorized the
Department to initiate the process of updating or amending the WUDP in contemplation of
development projections of the Kona CDP. Pursuant to HRS Chapter 174C and Section 29-3 of the
Hawai`i County Code ("HCC"), the Department, guided by the State Commission on Water Resource
Management ("CWRM"), worked to update the WUDP. As a result, the proposed update, "Hawai`i
County Water Use and Development Plan Update, Keauhou Aquifer System" attached as "Exhibit A,"
addresses regional water needs and source development strategies of the Keauhou Aquifer System,
taking into account demand projections of proposed land development, as well as traditional and
customary practice considerations.
Upon CWRM's initial approval of the update, the Department, acting through its Water Board,
proposed to amend the WUDP to include the aforementioned Keauhou Aquifer System Update at its
Board Meeting on June 27, 2017. Pursuant to Section 29-3 of the HCC, two hearings on the proposed
amendment were held, one in East Hawai`i on April 25, 2017, and one in West Hawaii on May 23,
2017. If Council approves this amendment to the WUDP, CWRM will then proceed with adoption of

A. REQUEST:
Request to approve Hawai'i County Water Use and Development Plan Update, attached as "Exhibit A",
which addresses the Keauhou Aquifer System.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
Pursuant to the State Water Code, Chapter 174C, Hawai'i Revised Statues and Hawaii County Code § 29-3,
Hawaii County's Water Use and Development Plan ("WUDP") has been reviewed by the Department of
Water Supply, and the Water Board authorized an amendment/update to the plan on May 27, 2014. This
proposed amendment is a refinement of the 2010 WUDP Update, specifically for the Keauhou Aquifer
System, and incorporates Kona Community Development Plan information regarding future
developments/projects. The 2010 Update took a broad, uniform approach island-wide to conservatively
evaluate the County's land use policies set forth in the County General Plan and Zoning Code. As required
by the State Water Code, this proposed update was guided by the State Commission on Water Resource
Management (CWRM) to address refined water demand projections as well as source development
strategies and scenarios.
The proposed update initially addressed regional water demand projections based on proposed •
developments, population growth projections, and preliminary findings on traditional and cultural issues
(Phase 1). Source development strategies and scenarios to meet the demand projections were
subsequently required by CWRM, as well as addressing traditional and cultural uses of water within the
aquifer system (Phase 2). CWRM approved the Phase 1 report on August 17, 2015 and Phase 2 on
February 14, 2017. The Water Board subsequently held public hearings as required by Hawaii County Code
§ 29-3, at its meetings on April 25, 2017 and May 23, 2017 in Hilo and Kona respectively.
If Council approves, DWS will transmit the updated WUDP to CWRM for final adoption into the Hawaii
Water Plan.
