Your Committee on Finance, to which was referred Bill 32, reports as
follows :
The purpose of Bill 32 is to allow reconstruction of damaged property
which resulted from the windstorm of January 14 through 16 , 1985
without strict compliance of all requirements cited in Chapters 5 , 9 ,
11 , 17 and 25 of the Hawaii County Code 1983.
The bill will give the Mayor the power to waive certain requirements
of the County Code chapters listed above , including permit fee ,
setback and parking requirements . Documented evidence of damage from
the windstorm need be provided; however , no waiver shall be used to
construct a nonconforming structure unless the structure was
nonconforming prior to January 14 , 1985 . The Mayor shall have these
powers up to and including 90 days after the effective date of this
ordinance , of which any waiver may be revoked at any time for
noncompliance of this ordinance or conditions and safeguards as set
forth . The bill also provides for an appeal procedure to the Council
for any action taken by the Mayor pursuant to this bill .
In committee discussion, Councilwoman Jitchaku was assured by the
Finance Chairman that the inspectors would continue to do site
inspections upon completion of repairs of wind damaged properties .
Your Committee on Finance concurs with the intent of Bill 32 and
recommends that it pass fist reading.
