HomeMy WebLinkAboutREP FC 527 07/25/1988 1984-1988 411• REPORT OF THE 111 COMMITTEE ON FINANCE Date: July 25 , 1988Re : °'Comm. 1705 Place : Councilroom Time: 10 :00 a.m. Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Finance, to which was referred Resolution No . 472-88, reports as follows: The purpose of Resolution No. 472-88 is to authorize the leasing of the County Skeet Shooting Range and Drag Strip to the State during the use of the Keaukaha Military Reservation Firing Range by the Armed Forces of the United States . Your Committee on Finance is aware that the State of Hawaii owns and operates the Keaukaha Military Reservation and thereon is located a 600-yard known distance rifle and small arms firing range. Your Committee is further aware that the County owns and operates a skeet range and -drag strip which are located in the vicinity of the Keaukaha Military Reservation and the portions of the facilities in question fall within an area that may be impacted by small arms projectiles fired during weapons qualifications at the range . Your Committee has been informed that the County desires to lease to the State those areas of land known as the skeet range and drag strip only during times when the known distance range is being used by members of the Armed Forces for live firing. This is being done in the interest of safety to all personnel concerned. Your Committee has also been informed of the- terms of the Lease Agreement, some of which are as follows: • 1 . The Department of Defense will provide the County with written schedules of when small arms firing will be conducted. 2. The County shall suspend use of the said facilities during the days designated for small arms firing unless written notice of a change is made at least 30 calendar days prior to the firing or unless both parties agree to a shorter notice. 3. The County may be called upon to aid in denying access to or removing anyone who may be at the respective sites illegally. FC REPORT NO. 527 ADOPTED : AUG a 1988 1 . . ,Y . _.. III 110 FC- 527 Page 2 July 25, 1988 4. The County will not be held responsible for any damages or liable for possible suits as a result of actions by the State. 5 . The State will be responsible for any damages caused by the act of negligence on the part of the State. The County may elect to repair such damage and thereupon be reimbursed by the State . 6 . The agreement can be terminated by either party upon furnishing of 30 days ' notice . Pursuant to Chapter 2, Article 19, Sections 2-111 and 2-120, Hawaii County Code, as amended, the Council may, by resolution, direct the Director of Finance to dispose of real property by leasing it to a government or governmental agency without notice or appraisal .
