No . 432-88, reports as follows:
The purpose of Resolution No . 432-88 is to transfer and appropriate
$73 ,624 . 71 as follows:

Your Committee on 'Finance has been advised that during the last
fiscal year , the Council approved an appropriation of $311,927 .57 to
cover the reimbursement of real property tax claims as a result of
the drought of 1983-1985 , which was certified by the Natural
Disaster Claims Commission on March 6 , 1986 .
Your committee has been further advised that the appropriated amount
was expended after the State first reimbursed the general excise tax
paid by the claimants during the 1983-85 years . After the State has
completed its general excise tax reimbursements for 1986-87 , the
share of the County' s refund is $73 ,624 .71. This figure does not
include four claims whose real property tax is undetermined because
of their failure to respond to an inquiry for further information.
The Director of Finance explained that the State and County are
mandated by state law to participate in a program of reimbursing
claimants for general excise and real property taxes paid during a
period of a declared state of emergency. Upon the declaration of a
state of emergency by the Governor of the State of Hawaii when a
disaster occurs, victims of such a disaster may file claims for
certain tax exemptions . Upon certification by the Natural Disaster
Claims Commission, the victims can receive compensation for taxes
paid upon filing proper claims .

It was explained to the committee that the tax claims. are meant for
specific situations only as certified by the Natural Claims
Commission. As an example, the drought that occurred in the years
1983-85 posed extreme financial hardships on farmers and ranchers in
stricken areas and they were certified to be entitled to tax refunds .
The committee was further informed that the funds requested are to
cover the next series of refunds.
Pursuant to Section 10-9 of the Hawaii County Charter , the Council ,
by resolution, may transfer part or all of any unencumbered
appropriation balance from one agency to another .
Your Committee on Finance is in accord with the intent and purpose
of Resolution No. 432-88 and recommen s its adoption.
