Your Committee on Finance, to which was referred Bill 447 , reports
as follows:
The purpose of Bill 447 is to repeal Ordinance No . 87-60 and all
amendments thereto and enact an ordinance adopting a pay plan for
persons employed by the County other than those whose pay is.
otherwise provided for . It further designates payroll periods, pay
days , prescribing certain requirements with respect to overtime,
perquisites and official fidelity bonds .
Your Committee on Finance learned in a letter from the Corporation
Counsel to the Department of Civil Service, dated June 17 , 1987 ,
that indicated that positions covered by the Civil Service
Classification Plan are inappropriately included in the current
salary ordinance and should be removed.
Your committee has further learned that in Section 5-1 . 5 (e ) of the
Charter , which describes the duties of the Mayor , it states that the
Mayor is to "recommend to the council a pay plan for all officers
and employees of the county or any of its boards and commissions,
except those whose pay is otherwise provided for ; provided that the
salary of any officer or employee who is exempt from the civil,
service laws shall be subject to approval by the council and the •
mayor . "
In interpreting this function of the Mayor , the Corporation
Counsel ' s Office has determined that civil service employees clearly
have their pay otherwise provided for and need not be listed in the
ordinance . The County Code contains a section relating to law
grades for deputy prosecuting attorneys and deputy corporation
counsels , however , only the grades are established . The pay is not
set, therefore, that remains in the ordinance .
The Deputy Corporation Counsel further explained that positions
which are exempt from civil service classification and pay laws
should probably be included in the salary ordinance and the Director
of Personnel agrees with that interpretation. The proposed
ordinance thus includes these exempt positions .

During discussion, your Committee on Finance heard from the
Personnel Director . He reiterated the fact that positions covered
by the civil service classification plan are inappropriately
included in the current salary ordinance . He also stated that the
Council essentially has a check over personnel matters through the
budgetary process and, therefore, has no need for a concern that its
powers will be eroded. He further stated that periodic personnel
reports can be made available without the necessity of going through
the procedures of amending the salary ordinance .
Members of the Finance Committee expressed concern that the Council
may lose control over personnel matters if the ordinance is
enacted . Some members felt that the Council may be giving up some
of its prerogatives which it might not be able to regain at some
future time . Further concern was expressed that the Council is in
need of an awareness of personnel matters on a more frequent basis
rather than only at the time of the annual budget hearings .
Members of the Finance Committee felt it was preferable to retain
the present system.
Your Committee on Finance is not in accord with the intent and
purpose of Bill 447 and recommends t t it be filed .
