Your Committee on Finance , to which was referred Resolution
No . 354-87 , reports as follows:
The purpose of Resolution No . 354-87 is to accept the donation of
benches , litter containers and planters , as approved by the Chief
Engineer , and agrees to indemnify and hold harmless the donors of
such items and the landowners or lessees of the land abutting the
sidewalks on which the items are placed for any and all injuries and
damages allegedly caused or contributed to by the placement of such
items on public sidewalks .
Your Committee on Finance is aware of the provisions of
Section 22-58 (c ) , Hawaii County Code , which states that any person
desiring to place an object on a sidewalk must obtain the approval
by resolution of the Council and upon approval , the donors and
abutting landowners of such object shall not be liable for any
injuries resulting from the placement of such object .
Section 22-58 (c ) also states that the Council shall provide for the
maintenance responsibilities of the objects .
Your committee is aware of the generous donation by the Kailua
Village Street Beautification Committee of benches , litter
containers and planters to be placed on the sidewalks within Kailua
Village .
Your committee has reviewed Resolution 354-87 and does not concur
that all of the requirements of Section 22-58 (c ) , Hawaii County
Code , have been clearly addressed .
Your committee has amended Resolution 354-87 by clearly indicating
the Council 's intention to approve the placement of the objects on
the Kailua Village sidewalks , provide that the Department of Public
Works be responsible for the maintenance of such objects and extend
its appreciation to the members of the Kailua Village Street
Beautification Committee of the generous donation .
