Your Committee on Finance, to which was referred Resolution
No . 338-87 , reports as follows:
The purpose of Resolution No . 338-87 is to authorize the Office of
Prosecuting Attorney to take the following actions:
1 . To lease 2 ,797 square feet of office space at $.55 per square
foot or $1 ,602 .35 per month, including State of Hawaii general
excise tax, from Capt. Cook Investment Company, Inc. , for the
period July 1 , 1987 to and including June 30 , 1989 .
2 . To pay a proportionate share, as determined from time to time,
of the landscaping and maintenance expenses incurred in
connection with the grounds and premises will be paid.
(Presently the cost of maintenance is $ .03 per square foot or
87 .40 a month, including State of Hawaii general excise tax. )
Your committee expressed concern about the need for such a large
space ( 2,797 sq. ft . ) for the Kona Prosecutor ' s Office . Assistant
Prosecuting Attorney Jay Kimura explained that there are now four
attorneys, three clerical staff members, investigator and a victims '
counselor which is a State-funded position in Kona. There is also a
need for additional space for library materials and filing cabinets .
A Councilmember observed that the Circuit Court in Kona handles
about 43 percent of the total workload in the Third Circuit which is
a reason for the additional workload in the Kona Prosecutor 's Office .
Your committee inquired as to the rationale for a two-year
rental-lease term. Mr . Kimura informed the committee that plans for
office space are not definite on a long-term basis as there are
plans for constructing a new facility as part of the third increment
to the Kona police station .
The committee was further informed that the additional space amounts
to about 500 square feet and would cost about $2 ,000 more per year .
However , in spite of the need for more funds, this can be offset by
the savings realized in the janitorial services contract fund .

Asked why the rate for the space was so reasonable ( 55 cents per
square foot ) in Kailua, Mr . Kimura replied that the Prosecutor 's
Office has been located there for a long time and that people who
rent space to government agencies get tax benefits .
Pursuant to Section 10-11 of the County Charter , the Council may, by
resolution, approve any contract , lease or other obligation
requiring payment of funds from appropriations of a later fiscal
year or of more than one fiscal year .
Your Committee on Finance concurs with the intent of Resolution
No . 338-87 and recommends its adoption .
