' 4 Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Finance, to which was referred Resolution No . 324-87 , reports as follows: The purpose of Resolution No . 324-87 is to approve the disposition of a shop building at Kau High and Pahala Elementary School , TMK: 9-6-05 :008 . The following are data relating to disposition of real property in general and the shop building at Kau High , in particular: 1 . A unique ownership situation exists in regard to real property in the County of Hawaii in that the land is owned by the State of Hawaii and the improvements thereon are owned by the County . 2 . The building is old and hazardous "with extensive termite infestation and rotted beams . 3 ._ The State Department of Education desires to construct •a new industrial arts building on the property . 4 . Chapter 2 , Article 19 , Hawaii County Code 1983 , provides for the disposition of real property by a resolution duly approved by a majority of the members of the Council . 5 . Section 2-112, Hawaii County Code 1983 , provides ,that unless the, Council finds substantial reasons to dispose of real property in some other manner , all dispositions of real property shall be made at public auction . Upon review of Resolution 324-87 , your Committee on Finance has found no specific statement of findings to warrant the disposition of real property in a' manner other than by public auction . Your committee has amended Resolution 324-87 to specifically delineate substantial reasons to allow for the disposition of the shop building by demolition rather than by public auction . FC REPORT N0 . 383' ADOPTED : AUG 5 1987 111 411 FC- 383 Page 2 July 27 , 1987 Therefore, your Committee on Finance concurs with the intent of Resolution 324-87 , as amended , and recommends its adoption which would authorize the County Director of Finance to notify the State of Hawaii Department of Education to proceed with the demolition process .
