RESOLUTION NO. 290 17
A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A MULTI-YEAR
HOUSING ASSISTANCE PAYMENT CONTRACT (AGREEMENT) WITH UHC
00525 HILO LIMITED PARTNERSHIP (PARTNERSHIP) OWNERS OF E KOMO
MAI, SELECTED FOR THE SECTION 8 PROJECT-BASED VOUCHER PROGRAM
(PBV PROGRAM) AS OFFERED THROUGH A PUBLIC NOTICE DATED
FEBRUARY 12, 19 AND 29, 2012.
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or
other obligation requiring payment of funds from the appropriations of a later fiscal year or of
more than one fiscal year, be approved by resolution; and
WHEREAS, the Office of Housing and Community Development(OHCD) entered
into a 5-year Housing Assistance Payment Contract with the Partnership following public
notice dated February 12, 19 and 29, 2012; and
WHEREAS, the current 5-year contract expires on October 31, 2017; and
WHEREAS, the Partnership has submitted a written request for a new 5-year
Agreement to provide rental assistance for up to eleven(11) eligible participants; and
WHEREAS, under the Project-Based Voucher Program, the OHCD will attach a
Section 8 Housing Assistance Payment Contract (Agreement) to existing structures; and
WHEREAS, the purpose of the Section 8 Project-Based Voucher Program is to
encourage property owners to make available rental housing units to low-income families that
are not within the current housing fair market rents; and
WHEREAS, the OHCD would like to assist eleven (11) units in the County of
Hawai'i under the funding available for this purpose; and
WHEREAS, the County of Hawai'i wishes to enter into a multi-year agreement with
UHC 00525 Hilo Limited Partnership, selected as a Section 8 Project-Based Voucher project
(the"Project") by the OHCD utilizing the Section 8 Project-Based Voucher Program's
evaluation process; and
WHEREAS, the OHCD is requesting authorization for the Mayor to enter into a
multi-year agreement with UHC 00525 Hilo Limited Partnership for the Project; now,
therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI'I that
the Mayor is hereby authorized to enter into a multi-year agreement with UHC 00525 Hilo
Limited Partnership for the Section 8 Project-Based Voucher Program offered through the
Public Notice dated February 12, 19 and 29, 2012.
BE IT FURTHER RESOLVED,that sufficient federal funds from the U.S.
Department of Housing and Urban Development will be budgeted in future fiscal years to
cover the anticipated obligations of the County under the terms of the agreement.
BE IT FINALLY FURTHER RESOLVED,that the County Clerk shall forward a
copy of this resolution to the Office of Housing and Community Development.
