The need for economic opportunities in Kau is well known. Kau is an economically depressed district with extremely limited employment available and a very limited economic base. The proposed small scale development and golf course renovation at Discovery Harbour would provide not only much needed employment but also an economic base benefiting the entire area. Throughout the CDP process, specifically those forums held at the Discovery Harbour Community Center, the local community expressed strong support for the development of what are known as the commercial 'gateway'properties (2 parcels totaling 30 acres) at the entrance to Discovery Harbour. Per CDP online documents, 185 residents are in support of developing these properties while 13 residents are opposed. Consensus being the land use designation would be Village Commercial or whichever designation allows for Village Commercial use (MDU or Resort Node). Much to the surprise of the local community the CDP land use designation is proposed as LDU citing conflict with the Discovery Harbour CC&R's. This alleged undefined conflict has been made by only 2 property owners out of a total of over 600. One being the current President of the home owners association and the second being a former Board member. Neither of these individuals are permanent residents. This allegation, and all subsequent actions, were never presented to nor approved by property owners. It remains unexplained why the Senior Planner chose to allow the allegation by two individuals to ignore the expressed wishes of the local community and make the recommendation for LDU. Attorneys for the home owners association insurance carrier have recently stated, in writing, the village commercial use of the gateway properties is defined, and allowed, in the Discovery Harbour charter. Further, it is now known that the golf course and gateway lots are not now nor have ever been members of the home owners association which is limited to residential lots by charter and CC&R definition. Based upon this new information,the stated wishes of the community and if deemed necessary to conform with the Discovery Harbour charter we ask the land use designation be changed to Village Commercial or appropriate designation allowing such.
