Your Committee on Planning, to which was referred /Bill No . 187 ,
reports as follows:
Bill No . 187 amends Chapter 23, Article 6 , Division 2, Section 23-84
of the Hawaii County Code , 1983 , relating to Water Waiver .
The purpose of Bill 187 is to exempt water systems in agricultural
subdivisions where land is classified as agricultural by the State
Land Use Commission and zoned a minimum of five acres by the County .
The bill was first heard by your Committee on May 27 , 1986 , at which
time it was referred to the Planning Department for their review and
comments .
Subsequent to transmitting the bill to the Planning Department, your
Committee received Communication 703 from the Department of Water
Supply, recommending that the amendments proposed in Bill 187 be
applicable only to areas where water systems do not exist .
Committee Chairman Takashi Domingo queried the Planning Director as
to the status of the bill . The Planning Director stated that the
Planning Commission is considering the bill and that he will be
recommending that it be denied . The Planning Director added that the
County has tens of thousands of subdivided parcels without water and
that approval of this bill will be a step toward increasing this
inventory .
Chairman Domingo also asked representatives of the Department of
Water Supply whether they had any comments they would like to make
regarding Bill 187 . The representatives answered in the negative .
Your Committee concurred with Chairman Domingo 's recommendation that
the files on Communication 703 and Bill 187 be closed since the
Planning Commission is currently reviewing Bill 187 .
