Your Committee on Planning, to which was referred Bill No . 642.,--
reports as follows:
Bill No . 642 amends Chapter 22, Article 1 , Division 7 , Section 22-31
of the Hawaii County Code , as amended , relating to restrictions on
peddling in certain public areas .
Section 22-31 ( 3) is amended to prohibit peddling along the entire
length of Alii Drive . Previously, peddling was permitted along
certain areas of Alii Drive .
Your Committee , at the suggestion of Councilman Sherwood Greenwell ,
amended section (b ) of the Bill to allow the Department of Public
Works to make the determination as to whether a proposed activity
should be permitted , and if the determination is a positive one , to
issue a permit to designate the time and place where such activity
may be conducted . The original bill required the Council to make the
determination and to issue a resolution to designate the time and
place where such activity may be permitted .
Councilman Greenwell stated that the permitting process could and
should be handled administratively .
Your Committee on Planning is in accord with the intent and purpose
of Bill No . 642, Draft 2, and recommends that it pass first reading .
